<br />10 Minutes <br /> <br />CASE ff1: <br /> <br />EASEMENT ACQUISITION REGARDING SEWER AND WATER <br />PROJECT FOR PROPERTIES SOUTH OF U. S. HIGHWAY #10 <br />By: Bill Goodrich, City Attorney. <br /> <br />Background: <br /> <br /> <br />As you were advised at your meeting on January 26, 1988, purchase agreements <br />were presented to both the Holaseks and Elofsons for easement acquisition. We <br />had asked that these documents be returned by February 1. 1988. Both parties <br />asked for additional time for review. We granted the time requests. <br /> <br />The Elofsons have been on vacation the past two weeks. I have had telephone <br />contact with them. They have requested certain revisions relating to specific <br />dates of construction, etc. I believe that we will reach a satisfactory <br />negotiated agreement upon their return. They have not asked for increased <br />benefits from those authorized by the Council on December 22. 1987. <br /> <br />The Holaseks have had their attorney revise our proposed agreement. Enclosed <br />is a copy of their proposed amended paragraphs. The City Engineer has <br />determined the increased costs to the City over those benefits agreed to on <br />December 22, 1987 to be as follows: <br /> <br />~ <br /> <br />Increased Cost <br /> <br />Grading <br />Lighting <br />Street Accesses <br />Storm Sewer <br /> <br />Undetermined* <br />$10,000.00 <br />5,550.00 <br />18.000.00 <br /> <br />Total Increased Costs <br /> <br />$33,550.00 <br /> <br />If the Holaseks' proposal is accepted, the total benefit given to them for the <br />easements would be $86,110.00 which is $29,680.00 above the City's estimated <br />appraised value. <br /> <br />*The City Engineer does not have enough data from the Holaseks to determine <br />exactly what the impact of this item will be in dollars to the City. <br /> <br />We have met with the Hanson's attorney and reviewed a proposal similar to that <br />offered to the Holaseks and Elofsons. I will have further information on their <br />response at the meeting. <br /> <br />Enclosed for your information are the proposed agreement changes offered by the <br />Holaseks. Available at the meeting will be the proposed condemnation <br />resolution. <br /> <br />Recommendation: <br /> <br />Staff recommends that the City not accept Holasek's counter-proposal and that <br />the City offer the appraised value to the Holaseks and if no acceptance of that <br />is made, a condemnation action be commenced, We will have more current <br />information regarding the Elofsons and Hansons at the meeting in order to <br />determine if they should also be included in condemnation action. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />....L <br />-L <br />-L <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br />t~ <br />
