<br />lOC: holrevag <br /> <br />REVISIONS TO REAL PROPERTY AND EASEMENT ACQUISITION <br />AGREEMENT between city of Ramsey and Mr. and Mrs. Holasek, <br />and Mr. and Mrs. Hamilton. <br /> <br />'Paraqraph 2. b. : <br /> <br />This paragraph is revised to read: <br /> <br />b. Excess Earth Material. The LAND OWNERS shall promptly <br />develop a grading plan for their land, which they shall <br />submit for approval by the Planning and zoning <br />commission and by the city council in the ordinary <br />course. The CITY'S plan for the grading of Front Street <br />shall be consistent with the LAND OWNERS' approved <br />grading plan for their Land. All excess earth material <br />removed in the course of the construction of Front <br />Street or the sewer and water utility improvements <br />referred to below, and not needed for such construction, <br />shall, at LAND OWNERS election, remain on LAND OWNERS' <br />Property, and the CITY shall spread it on such Property <br />at the direction of the LAND OWNERS and in accordance <br />with the approved grading plan for the Property. If <br />LAND OWNERS shall elect not to keep such excess earth <br />material, then the CITY shall remove it at no cost to <br />LAND OWNERS. <br /> <br />Paraqraph 2.c.: <br /> <br />This paragraph is revised to read: <br /> <br />c. Liqhtinq. The CITY, at its sole expense, shall cause to <br />be constructed a minimum of five (5) street light <br />standards for lighting along the Front Street right-of- <br />way. The street lighting will be installed on the same <br />schedule as the street construction described above. <br />The LAND OWNERS' Property will NOT be specially assessed <br />for any benefit the LAND OWNERS' Property may receive <br />from said street lighting improvement. The standard of <br />lighting shall be at the sole discretion of the CITY and <br />the CITY shall pay for the electricity used by the <br />street lights. <br /> <br />Paraqraph 2. d. : <br />This paragraph is revised to read: <br /> <br />d. Front Street Access. The CITY shall construct, at no <br />cost to LAND OWNERS, two (2) private residential <br />accesses onto Front Street from LAND OWNERS' Property <br />lying south of Front Street, and three (3) private <br /> <br />AO <br />
