<br />10 Minutes <br /> <br />CASE 117: <br /> <br />ISSUES RELATIN; 'ro aJ'ILOl' B, <br /><XXJNl'RYSIDE FSl'ATES <br />By: Bill Goodrich, City Attorney <br /> <br />Unfortunately, the actal plat of the map does not show any of the outlots as <br />park, only as outlots. <br /> <br />The developer of the plat was First Guaranty Corporation, Mr. Arthur K. Raudio, <br />President, and Mr. Joseph E. Campion, Secretary. SUbsequent to the platting, <br />First Guaranty Corporation app:irently ignored the fact that they had dedicated <br />the lot to the City as park and proceeded to act as if it owned the lot by <br />mortgaging it amongst other things. Anoka County did not recognize the lot as <br />a park as it was taxing this lot and eventually took it back because of <br />property tax forfeiture. At sane point in time, Central Investment Company <br />became involved with the property and attempted to redean it fran Anoka County. <br />The City did not recognize the property as park land either as the City <br />particip:ited in the tax redemption process and agreed to split the lot with <br />Central Investment Company. The City kept a portion of the lot for drainage <br />pUrPOses and the balance was redeemed by Central Investinent Company. Centr al <br />Investment Company then sold the lot to Chateau Construction Company owned by <br />Mr. Dick Carson who has now constructed a hane on the property. Mr. Carson's <br />title comp:my did not discover the p:irk issue, and therefore allowed the home <br />to be built. 'Ihere is now a hane on the property and I believe a closing on <br />that property was held on December 15, 1987 and a new hane o,..ner now resides on <br />the property. <br /> <br />The best that could be said is that there has been a series of errors made by <br />several people. The OI".ly way to resolve the issue at this point \-",ould be for <br />the City to undertake a vacation proceedings to vacate a portion of the lot in <br />which the hane has been constructed.
