The Commission proceeded to review and amend the proposed tindings of fact <br />as follows: <br />Item #1 - Change '...has properly applied...' to '...has applied...' <br />Item #9 - Change to read as follows: 'That the Applicant is proposing <br />to keep the bears in a 35' x 45' enclosure with 8 walls (inside <br />measurement) consisting of three poured concrete block walls and one <br />chain link fence wall.' <br />Item #10 - Change to read as follows: 'That the structure specified in <br />Item #9 is located approximately 27 feet from the side yard line on the <br />north side and approximately 83 feet from the rear yard line.' <br />Item #14 - Change 'That the Applicant had at least one black bear...' to <br />'That the Applicant had two black bears...'. <br />Motion by Commissioner Shumway and seconded by Commissioner Howell to add <br />the following to the proposed findings of fact: <br />Item #21. That not all people in the affected area are opposed to the <br />keeping of the bears. <br />Notion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Howell and Shumway. Voting No: None. Absent: Commissioners Holm <br />and Terry. <br />Motion by Commissioner Hendriksen and seconded by Commissioner Shumway to <br />add the tollowing to the proposed findings of fact: <br />Item #22. That the block structure referred to in Item #9 and the <br />improvements to the existing foundation were created prior to <br />the implementation of city Code Section 110.18. <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />Howell, LaDue and Shumway. Voting No: None. Absent: Commissioners Holm <br />and Terry. <br />Motion by Commissioner Howell and seconded by Chairman Zimmerman to add the <br />following to the proposed findings of fact: <br />Item 423. That the Applicant has taken steps to render the animals <br />harmless by declawing, neutering and removing the canine <br />teeth from the male bear and removin- the front claws from <br />the temale bear. <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, <br />LaDue, Howell and Shumway. Voting No: None. Absent: commissioners Holm <br />and Terry. <br />Notion by Commissioner Shumway and seconded by Commissioner Howell to <br />recommend that City Council adopt the findings of fact, as amended, <br />relating to Mr. Tom Guyer's request for a wild animal license. <br />Planning and Zoning Commission/March 1, 1988 <br />Page 4 of 6 <br />
