sandwich shop he plans to develop on the property within 5 years and the
shop that currently exists in Coon Rpaids.
Notion by Chairman Zimmerman and seconded by Commissioner Shumway to amend
the proposed findings of fact as follows:
Add Item #19 - That there is a 9' x 16' sign existing on the property.
Motion carried. voting Yes: Chairman Zimmerman, Commissioners Shumway,
Terry, Howell and LaDue. Voting No: None. Absent: Commissioners Holm
and Hendriksen.
Ms. Norris reported that the City Attorney has determined that Mr. Shay's
proposal to advertise the sandwich shop to be developed on the property
meets the code requirements for free - standing signs.
Commissioner LaDue suggested that Mr. Shay could avoid the need for a
conditional use permit by just changing the advertising copy on the
existing sign on the property.
Chairman Zimmerman stated that in his opinion, advertising an activity that
may taKe place on the property within the next 5 years does not meet code
requirements to advertise an activity on or within 2500 feet of the subject
property.
Motion by Commissioner Howell and seconded by Commissioner LaDue to
recommend that City Council adopt the proposed findings of tact, as
amended, relating to Mr. Shay's request for a conditional use permit.
Motion carried. voting Yes: Chairman Zimmerman, Commissioners Shumway,
Terry, Howell and LaDue. voting No: None. Absent: Commissioners Holm
and Hendriksen.
Motion by Commissioner Howell and seconded by Commissioner Shumway to
recommend that City Council deny Mr. Shays request for a conditional use
permit.
Further Discussion: Mr. Shay inquired it the Commission would be more
favorable to the request if he shortened the length of time on the permit
to 3 years. Chairman Zimmerman stated that his main concern is limiting
the number of signs along Hwy. #10, not with the length of time for which a
permit for a sign is issued. Commissioner Howell noted that the City just
paid for a study of the Hwy. #10 corridor that recommends limiting
advertising to one sign per business.
Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway,
Terry and Howell. Voting No: Commissioner LaDue. Absent: Commissioners
Holm and Hendriksen.
Reauest For _ u t- Pl A The N.
