<br />Chairperson Nixt stated in theory what they had done was to provide connectivity to the <br />contiguous development and the traffic flow would move smoothly on the site without having to <br />move south. <br /> <br />Associate Planner DaInes noted if the drive thru were put on the east end, people would not have <br />to loop around the building. <br /> <br />Board Member Brauer stated the issue is can the ordinance be met by changing the building <br />orientation. If so, in effect that is granting a variance to do this particular site plan and he had a <br />problem with this. <br /> <br />Board Member Van Scoy stated he did not have a problem with the bank and the drive thru. <br /> <br />Chairperson Nixt stated he was in favor of granting the variance and he would rather work on <br />this from the site plan side than the variance side. <br /> <br />Board Member Cleveland asked if they denied the variance, would they not address the site plan. <br /> <br />Chairperson Nixt responded they would still need to make a recommendation on the site plan. <br /> <br />Board Member Levine stated in looking at the elevation, he did not see a bad side to the building. <br /> <br />Board Member Van Scoy stated he original intent was to put the buildings long the streets and <br />when they looked at this, the building was a long ways away from the street. <br /> <br />Chairperson Nixt stated the reason he was leaning this way is because it is the TC-2 district and <br />not the TC3 or 4 District, where the regulations are a lot less flexible. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Hunt, to adopt Resolution #06-08-251 <br />adopting Findings of Fact #0772 relating to a request from Shingobee Builders, rnc for a variance <br />to maximum front yard setbacks for the proposed Klein Bank to be constructed in the TC-2 <br />Commercial District of Town Center. <br /> <br />Further discussion: Board Member Van Scoy stated in his opinion this could be easily resolved <br />by the reorientation of the building as this was the original intent. <br /> <br />Motion Carried. V oting Yes: Chairperson Nixt, Board Members, Hunt, Cleveland, Levine, and <br />Trites Rolle. Voting No: Board Members Brauer and Van Scoy. Absent: None. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Levine, to approve the request for a <br />variance to maximum front yard setback requirements for Shingobee Builders, based on the <br />findings of fact, and adopt Resolution #06-08-252 declaring terms of same. <br /> <br />Motion Carried. V oting Yes: Chairperson Nixt, Board Members Cleveland, Levine, Hunt, and <br />Trites Rolle. Voting No: Board Members Brauer and Van Scoy.
