<br />Ramsey City council <br />Page 2 <br />May 2J.., J..997 <br /> <br />By their letter dated April 3, J..997 , Kennedy & Graven opined that <br />the ci ty had properly fellowed necessary legal procedures in <br />adopting the Plan Amendment. The Metropolitan Council granted its <br />approval of the Plan Amendment on January J..2, J..995 by adopting the <br />report of its communi ty Development committee. The community <br />Development Committee adopted the Metropolitan Council Staff Report <br />dated December 30, 1994 (the "Met Council staff Report"). The <br />Ramsey City Council granted its approval of the Plan Amendment <br />pursuant to Resolution 95-0J..-0J..8 adopted on January J..O, 1995. <br />Ramsey's Resolution had attached to it relevant parts of the report <br />and recommendation from the Met Council Staff Report. <br /> <br />The significant part of the Met Council's Staff Report for this <br />memorandum is Attachment 2 which is a map showing the proposed MUSA <br />expansion area ("Attachment 2"). Attachment 2 is attached to this <br />memorandum and labeled Exhibit "A". Attachment 2 was prepared by <br />Ramsey Staff. The Met Council Staff Report references Attachment <br />2 in stating "The proposed MUSA land is generally located to the <br />north and west of current urban service area. See Attachments 1 <br />and 2." Attachment J.. is a map of the entire Twin cities <br />metropolitan area and not relevant to this memorandum. There is <br />another map attached to the Met council Staff Report marked <br />"Attachment 5". Attachment 5 is a Ramsey Zoning Map prepared by <br />Ramsey Staff which shows a slightly different MUSA line than shown <br />on Attachment 2. However, the text of the Met Council Staff Report <br />references Attachment 5 in the context of Regional Policy issues <br />relating to the City's zoning uses as opposed to establishing the <br />MUSA boundary and therefore I conclude that Attachment 5 did not <br />establish the MUSA boundary. <br /> <br />The last MUSA boundary map submi tted by Ramsey Staff prior to <br />January J..O, J..995 was Attachment 2. significantly, Attachment 2 was <br />formally approved by both the Metropolitan Council and the city <br />Council as the MUSA boundary on January J..2, 1995 and January 10, <br />J..995 respectively. Neither the Ramsey city council nor <br />Metropolitan Council formally approved any other map depicting a <br />different MUSA boundary other than as shown on Attachment 2. <br /> <br />After the January J..2, J..995 Metropolitan council action, Robert <br />Davis requested from Ramsey Staff a more detailed map of Attachment <br />2 in order for the Metropolitan Council's staff to show the MUSA <br />boundary on their Geographic Information systems map.
