10. <br /> <br />11. <br /> <br />12. <br /> <br />t3. <br /> <br />14. <br /> <br />Noise, Noises emanating from the site and operations shall be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Regulations <br />MPC, as amended except as modified herein by City requirements. <br /> <br />Dust. The emission of dust or other particulate matter shall be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Regulation <br />APC 1-15, as amended except as modified herein by City requirements. <br /> <br />Surfacing of Work Areas. All equipment maneuvering areas, driveway areas, access <br />and perimeter roads shall be either bituminous or concrete surfaced. Use of processed tire <br />chips is prohibited for surfacing material. <br /> <br />Outside Storage of Materials and Equipment. The outside storage of debris, <br />exclusive of raw materials otherwise permitted under this conditional use permit, and <br />inoperable vehicles and equipment shall not be permitted. <br /> <br />Hours of Operation. The hours of the receiving of materials and operation of outdoor <br />mechanized equipment shall be limited to 7:00 a.m. to 5:00 p.m. Monday through Saturday <br />provided, however, that use of mechanized equipment shall not extend beyond 1:00 p.m. <br />on Saturdays. There shall be no receipt of materials on Sundays and legal holidays. IPS, <br />at its discretion, may schedule a lesser number of hours of operation w/thin these limits. <br /> <br />Control of Operations. All hauling, shredding and other activities incidental to the <br />composting operation shall be conducted in conformance with state and federal regulations <br />and in accordance with the applicable requirements of the Performance Standards of the <br />City Code (§9.10). Operations must be conducted so as to minimize noise, safety, odor, <br />dust, visual impacts or other nuisance concerns to adjacent residential properties. <br /> <br />On-Site Fire Protection. IPS shall have available on-site sufficient fire fighting <br />materials which at a minimum shall be no less than 100 cubic yards of sand and <br />extinguishers on each piece of equipment such that advance efforts can be made in <br />extinguishing a fire either by IPS personnel or City forces. IPS shall provide a safety <br />communications line at the site at all times during the term of this CUP when operating <br />equipment at the site. IPS shall also be responsible for any fire suppression costs required <br />at the facility. <br /> <br />Pest Control. Insects, rodents and birds on the site shall be controlled and exterminated <br />as needed and additional control may be directed by the City Inspector subject to all <br />applicable laws, rules and regulations. <br /> <br />Traffic. Vehicles shall utilize U.S. Highway #10 and Sunfish Lake Boulevard N.W. <br />(County Road 57) exclusively when traveling to and from the facility. IPS shall <br />communicate and attempt to ensure that non-owned vehicles traveling to the facility utilize <br />these same roads. Vehicles with origination points or service stops in the City may utilize <br />local roads as necessary. <br /> <br />Litter Control. IPS shall be responsible for removing litter and debris along Sunfish <br />Lake Boulevard N.W. caused by vehicles using the composting facility. Litter and debris <br />removal activities shall be instituted promptly following information of such accumulation. <br />In the event IPS fails to remove litter or debris within 24 hours of notice by the City, the <br />City may cause such litter or debris to be removed. The City shall bill the cost of such <br />removal to IPS, and payment shall be remitted within 30 days of such billing.
