Voting No: None. <br /> <br />Case #6: Service Availability Charge (SAC) Refunds: <br /> <br />Mr. Hartley recalled that City Council has instructed Staff to prepare an <br />application to the Metropolitan Waste Control Commission for a refund of <br />SAC charges which have been made to prop:rties where sanitary sewer service <br />is not available and that the refund be retained by the City rather than <br />returned to the prop:rties. Mr. Hartley noted that the response from the <br />public has been that the prop:rty CMners would like to receive the refund. <br />Mr. Hartley requested Council to reconsider their past direction to Staff. <br /> <br />Motion by Mayor Reimann ana seconaea by Councilnernber Pearson to authorize <br />the City Administrator to make application to the Metropolitan Waste <br />Control Commission for a refuna of $92,557.00 for Service Availability <br />Charges and to distribute the refuna to appropriate prop:rty CMners. <br /> <br />Further Discussion: Mr. Hartley noted that if the City retainea the <br />refunds ana if sewer became available to those prop:rties, the City would <br />be responsible for paying the SAC for those prop:rties at the future rate. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca ana <br />Pearson. Voting No: None. Abstain: Councilmember Sorteberg. Absent: <br />Councilnember Cox. <br /> <br />Council recessed at 9:01 p.m. <br />Mayor Reimann callec1 the meeting back to order at 9:15 p.m. <br /> <br />Case *7: Ado.Pt Ordinance Amencing Section 110 of the City Code <br />Regardino Regulations For Ke~L~o Vicious Dogs: <br /> <br />Motion by Councilmernber Sorteberg and seconded by Councilrnernber Pearson to <br />adopt Ordinance *88-2 amending Section 110 of the City Code establishing <br />regulations for keeping vicious dogs. (Please refer to ordinance file for <br />Ordinance i'88-2). <br /> <br />Motion carried. Voting Yes: I>Iayor Reimann, Councilmembers Sorteberg, <br />DeLuca and Pearson. Voting No: None. Absent: Councilmember Cox. <br /> <br />Case :1=8: Discuss Proposed Ordinance Reou1 atino The Keepino Of Horses: <br /> <br />Hr. Hartley recalled that at it's last meeting, Council chose not to take <br />.~ny action on the ordinance amendment pro:r:;osea by the Planning and Zoning <br />Comrrission recaraino reoulations for keepino horses.
