<br />3. No person shall keep any horse ~n a manner creating a public or <br />private nuisance. <br /> <br />110.075 CONTROL, TRESPASS AND PUBLIC ROADWAYS <br /> <br />1. No person, firm or corporation shall permit any horse of ~hich he <br />is the o~ner, caretaker or custodian to run at lsrge ~ithin the <br />city. Such animal ,dll be deetned to run at large ~hen it is off <br />the premises owned or rented by its owner and unaccompanied by <br />the owner, or an agent or employee of the owner. <br /> <br />2. The chief of police or any designated agent of the city may <br />impound any such animal found at large and shall provide proper <br />sustenance for any and all animals impounded. The chief of <br />police or his designated agent shall, within 24 hours after any <br />such animal has been impounded, post written notice at the city <br />hall describing such animal aud st.ting that it has b~en <br />impounded. If the owner of such impounded animal is known to the <br />person impounding, personal service of notice of such impound ing <br />shall be served within 24 hours after impounding upon such owner <br />in the manner prescribed by State law for tbe service of process. <br /> <br />3. No legally impounded animal shall be released except to the <br />person displaying a receipt from the city clerk showing payment <br />in ful). for the costs of impounding and care of the lrnimal. If <br />any person, without authority of 1 a,,' , and without first paying <br />the costs due, shall take any impounded animal out of the <br />enclosure in ~hich it is impounded, he shall be guilty of a <br />misdemeanor. <br /> <br />4. Costs incurred by the city in impounding horses running at large <br />shall be paid by the owner of the horse prior to releasing said <br />animal. No such animal impounded shall be released except to <br />a person displaying a receipt from the city clerk showing payment <br />of the reasonable costs of impounding, cost of feeding and vet <br />care, if required. <br /> <br />5. If any horse impounded is not redeemed within fourteen days, the <br />chief of police or his designated agent snall give an additional <br />tnree days notice of tbe time and place where such animal or <br />animals will be sold by posting and serving notices as required <br />for notice herein. If such animal cannot be sold on the dav <br />stated, it may be sold as soer: as possible thereafter withou~ <br />notice. <br /> <br />6. The city clerk shall turn over the proceeds or any sale to the <br />city treasurer. On order of the city council, the city ~reasurer <br />shall pay to the owner of such animal the difference between the <br />sale price, after deducting the cost of i~pounding, feeding and <br />sales charges, if the owner makes claim for the monies witbin one <br />year from the date of sale; otherwise, it snaIl be forfeited to <br />the city. <br /> <br />7. No person may ride or drive a horse after the hour of sunset and <br />before the hour of sunrise along or crossing any public way <br />without appropriate lighting or reflectorized clothing. <br /> <br />~ <br />
