<br />Mr. Dave Schulte. Mr. Dale Vcltin and Mr. John Rambosek were present to <br />review their sketch plans for Voltin's Oak Hill Estates and Rambosek's Red <br />Oaks. <br /> <br />Council viewed the sketch plans favorsbly and suggested that the plats <br />address future subdivision and road alignments that would coordinate with <br />any future development that might occur on the adjacent Bill Weiss <br />property. <br /> <br />Case ~2: Ken Miller Well Problem: (Continued): <br /> <br />Mr. Hartley stated that he has reviewed the proposed agreement with Mr. and <br />Mrs. Ken Miller and they are agreeable to it. <br /> <br />Council~ember Cox inquired if it has been determined that there is a well <br />problem that is the responsibility of the City and why the well hasn't been <br />retested since the return of the water table to where it was before <br />construction began. <br /> <br />Mr. Goodrich stated tbat he cannot say whether the dollar amount Mr. <br />Hartley proposes reflects the dollar amount of the City's responsibility <br />but the City does have some liability for the interruption of water service <br />to the Millers ,for a period of time. <br /> <br />Hr. Hiller stated that nobody can get the well to work. <br /> <br />Hr. Hartley noted that the proposed egreement is buying certainty that the <br />connection charge for sewer and water for.that property will eventually be <br />palG and that is important when there is a grandfather use inconsistent <br />with current zoning. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson <br />indicating that even though it is inconsistent) City Council approves <br />entering into an agreement. with terms as proposed) to provide municipal <br />water service to the Ken Hiller property in order to resolve the matter of <br />the malfunctioning private well and assure the City that the subject <br />property will eventually pay the sewer and water connection charge. <br /> <br />Fu=tber Discussion: Councilmember DeLuca stated that be has seen no <br />clcc~e~tation that previous conta~ination or the well had been resolved and <br />that the current interruption of water se~'ice was to a well fit for human <br />consumption. Councilmemher Sorteberg noted that the City also doesn't have <br />documentation proving the well was contaminated at the time of the service <br />interruption. Councilmember Pea=son noted that Mr. Hiller's well is only <br />17 feet deep but he had the same situation happen to him and nis well .as <br />50 reet deep. <br /> <br />Motion carried.
