JOINT POWERS AGREEMENT <br />Anoka County Contract # 2006 -0275 <br />THIS AGREEMENT, made this 14 day of November, 2006, notwithstanding the dates of the <br />signatures of the parties, by and between the City of Ramsey, Minnesota (the "City ") and the Northstar <br />Corridor Development Authority (the "NCDA), pursuant to Minn. Stat. § 471.59. <br />RECITALS <br />WHEREAS, the Northstar Corridor along Trunk Highway 10 from Minneapolis to St. Cloud is a <br />transportation corridor in the fastest growing area in the State of Minnesota and such growth has created <br />significant transportation, safety and land use issues; and <br />WHEREAS, in October 2001, the Northstar Commuter Coach Demonstration Project <br />commenced in order to build ridership for the Northstar commuter rail project between the Cities of Elk <br />River and downtown Minneapolis; and <br />WHEREAS, on April 21, 2006, the City advised the NCDA that it wishes to initiate additional <br />express bus service from the City of Ramsey to downtown Minneapolis as part of the Northstar <br />Commuter Coach Demonstration Project, contingent upon the receipt of federal funding for this <br />additional service; and <br />WHEREAS, on June 2, 2006, the NCDA issued a Request for Proposals ( "RFP ") for a qualified <br />vendor to provide professional and technical services for the Northstar Commuter Coach Demonstration <br />Project between the cities of Elk River and Minneapolis and included an option for service between the <br />cities of Ramsey and downtown Minneapolis; and <br />WHEREAS, on August 3, 2006, the NCDA awarded a contract to Laidlaw Transit Services <br />( "Laidlaw ") for these professional and technical services with an option for express commuter coach <br />service between the cities of Ramsey and downtown Minneapolis; and <br />WHEREAS, the City and•the NCDA desire to jointly operate commuter coach service along the <br />Northstar Corridor and work toward the goal of building ridership for the Northstar Commuter Rail <br />Project. <br />NOW, THEREFORE, in consideration of the mutual promises and benefits that each party shall <br />derive here from, the parties agree as follows: <br />I. PURPOSE <br />The purpose of this Agreement is to expand the Northstar commuter coach service to provide for the <br />operation of express commuter coach service from the city of Ramsey to downtown Minneapolis in order <br />to jointly address the need for transit services along the corridor and to build ridership for the Northstar <br />commuter rail project. <br />II. DESCRIPTION OF PROJECT <br />The Parties wish to operate the Ramsey Coach Service ( "Ramsey Coach Service "), as set forth in the <br />Agreement for Northstar Commuter Bus Service Demonstration Project between the NCDA and Laidlaw <br />1 <br />• <br />
