JOINT POWERS AGREEMENT Anoka County Contract # 2006 -0275 THIS AGREEMENT, made this 14 day of November, 2006, notwithstanding the dates of the signatures of the parties, by and between the City of Ramsey, Minnesota (the "City ") and the Northstar Corridor Development Authority (the "NCDA), pursuant to Minn. Stat. § 471.59. RECITALS WHEREAS, the Northstar Corridor along Trunk Highway 10 from Minneapolis to St. Cloud is a transportation corridor in the fastest growing area in the State of Minnesota and such growth has created significant transportation, safety and land use issues; and WHEREAS, in October 2001, the Northstar Commuter Coach Demonstration Project commenced in order to build ridership for the Northstar commuter rail project between the Cities of Elk River and downtown Minneapolis; and WHEREAS, on April 21, 2006, the City advised the NCDA that it wishes to initiate additional express bus service from the City of Ramsey to downtown Minneapolis as part of the Northstar Commuter Coach Demonstration Project, contingent upon the receipt of federal funding for this additional service; and WHEREAS, on June 2, 2006, the NCDA issued a Request for Proposals ( "RFP ") for a qualified vendor to provide professional and technical services for the Northstar Commuter Coach Demonstration Project between the cities of Elk River and Minneapolis and included an option for service between the cities of Ramsey and downtown Minneapolis; and WHEREAS, on August 3, 2006, the NCDA awarded a contract to Laidlaw Transit Services ( "Laidlaw ") for these professional and technical services with an option for express commuter coach service between the cities of Ramsey and downtown Minneapolis; and WHEREAS, the City and•the NCDA desire to jointly operate commuter coach service along the Northstar Corridor and work toward the goal of building ridership for the Northstar Commuter Rail Project. NOW, THEREFORE, in consideration of the mutual promises and benefits that each party shall derive here from, the parties agree as follows: I. PURPOSE The purpose of this Agreement is to expand the Northstar commuter coach service to provide for the operation of express commuter coach service from the city of Ramsey to downtown Minneapolis in order to jointly address the need for transit services along the corridor and to build ridership for the Northstar commuter rail project. II. DESCRIPTION OF PROJECT The Parties wish to operate the Ramsey Coach Service ( "Ramsey Coach Service "), as set forth in the Agreement for Northstar Commuter Bus Service Demonstration Project between the NCDA and Laidlaw 1 •
