~

llorham: Yes, that was correct. The question was, do you know what the soils are ~
, around the area that is to be zoned 1

.

Lukerman: I can only answer that question by looking at the map and saying that on the
wet lands map there is no land that is shown of the 93 acreas that appears as wetlands
on this map of Mr. Tucker's. Immediately to the south of the small residential area
between 5 and trunk Hwy #>47, there is an extensive area of severe limitations for
urban development immediately to the south. But onthesubject's site, I do not see any
severe limitations for the property for urban development.

Albert: Now, you discussed a comprehensive plan. Could you say to us whether or not a
comprehensive plan is something that is never supposed to be changed?

Eukerman: No, but, it should be very carefu1~y scrutenized.

Albert: But it should be subject to change should it not?

Lukerman: It should be subject to change in an integrated fashion.

.Albert: So, that a comprehensive guide or plan is not a zoning map. is it?

Lukerman: No, it isn't.

Albert: And, it is to subject of change by the governing agency or the legislative
agency of the community in which the land lies. And, so if the Council in its judgement
feels that there ought to be a change by a rezoning and that affects the comprehensive
plan, that the questions that is really in your mind is whether that is a sound judge-
ment, is that right?

. Lukerman: The question in my mind is that the change necessitates a major change to the
total comprehensive plan ....INTER~UPTION....

Albert: Well, one of the major changes that you said was that it does need sewer. Right?

Lukelwan: No. It does need sewer, but that isn't the major change.

Albert: Didn't you say that one of the major cost factors that should be considered by
this community, to be born entirely by this community, wastthe fact that it would
require a sewer line?

Lukerman: It would prematurely development beyond the boundries of the urbanized area.
Then, if it were necessary for the sewer board to bring out an inteceptor to service
a premature development, then under those conditions it would be local units governments
responsibility to.....INTER~UPTION....

Albert: Now you quote me please, chapter and verse where you get that information, from
where you get that information, which is a part of the law of the state of Minnesota,
please.

A LONG LENGTH OF PAGING THRU A BOOK....

Lukerman: Could you give me a couple of minutes; I've got so many pieces of paer. I
know I have it here.

Oliphant: Could I ask your indulgence to give her just a couple of minutes just to
look thru her papers?

. Goodrich: Mr. Albert, could I ask you the purpose of these minutes? state your pacific
question now.

Albert: My question is in view of her previous answer. Can she give us the statutory
authority for her statmentthat the entire cost would be born by the City of Ramsey?
