<br />. <br /> <br />K. That Councilman Gorham's primary occupation involves construc- <br /> <br />tion and home bui ld.ing . <br />L. That Councilman Gorham abstained from the original vote on <br /> <br />March 24, 1975, on the rezoning issue believing his vote was not <br /> <br />needed for the measure to pass. <br /> <br />M. That following the first meeting at which the vote was 3-1-1 <br /> <br />research by the City Attorney resulted in an opinion that the measure <br /> <br />had failed. Councilman Gorham, at the next meeting of the City Council <br /> <br />held April 14, 1975, changed his vote to yes, causing the area to be <br /> <br />rezoned from residential to commercial. That prior to casting his <br /> <br />vote, Councilman Gorham obtained an Opinion from the State Attorney <br /> <br />. General's office indicating there was not a conflict of interest. <br /> <br />Petitioners are unaware of the extent of the facts given to the <br /> <br />Attorney General's office which resulted in the opinion. <br /> <br />v. <br /> <br />That the action by the Ramsey City Council arbitrarily, unreason- <br /> <br />ably, and illegally changed the Comprehensive plan for the Orderly <br /> <br />Development of the City of Ramsey. <br /> <br />A. That during July, 1973, a comprehensive plan was prepared <br /> <br />for the Orderly Devel opment of the City of Ramsey (then township). <br /> <br /> <br />B. That the comprehensive plan was apparently adopted by the <br /> <br />Ramsey City Council, although petitioners do not have the exact date <br /> <br />. of its acceptance by the Council. <br /> <br />C. That the comprehensive plan recommended three small commercial <br /> <br />shopping centers close to the residential centers proposed. in the <br /> <br />plan (see p. 25, Comprehensive Plan). <br /> <br />D. That the comprehensive plan envisioned three general community <br /> <br />areas served by separate elementary schools, recreation areas and a <br /> <br />small shopping center (see page 24, Comprehensive Plan). <br /> <br />. <br /> <br />E. That the Comprehensive Plan indicated that future commercial <br /> <br />construction would focus on highways 10 and 52. <br />
