That Councilman Gorham abstained from the original vote on March 24, 1975, on the rezoning issue believing his vote was not needed for the measure to pass. M. That following the first meeting at which the vote was 3-1-1 research by the City Attorney resulted in an opinion that the measure had failed. Councilman Gorham, at the next meeting of the City Council held April 14, 1975, changed his vote to yes, causing the area to be rezoned from residential to commercial. That prior to casting his vote, Councilman Gorham obtained an Opinion from the State Attorney . General's office indicating there was not a conflict of interest. Petitioners are unaware of the extent of the facts given to the Attorney General's office which resulted in the opinion. v. That the action by the Ramsey City Council arbitrarily, unreason- ably, and illegally changed the Comprehensive plan for the Orderly Development of the City of Ramsey. A. That during July, 1973, a comprehensive plan was prepared for the Orderly Devel opment of the City of Ramsey (then township). B. That the comprehensive plan was apparently adopted by the Ramsey City Council, although petitioners do not have the exact date . of its acceptance by the Council. C. That the comprehensive plan recommended three small commercial shopping centers close to the residential centers proposed. in the plan (see p. 25, Comprehensive Plan). D. That the comprehensive plan envisioned three general community areas served by separate elementary schools, recreation areas and a small shopping center (see page 24, Comprehensive Plan). . E. That the Comprehensive Plan indicated that future commercial construction would focus on highways 10 and 52.
