[TIRE PROCESSOR.] "Tire processor" means a <br />6 person engaged in the processing of waste tires. <br />7 Subd. 11. [WASTE TIRE.] "Waste tire" means a tire that is <br /> <br />8 no longer suitable for its original intended purpose because of <br />9 wear, damage, or defect. <br />10 Sec. 94. [115A.902] [PERMIT1 TIRE COLLECTORS, PROCESSORS.) <br />11 Subdivision 1. [PERMIT REQUIRED.] A tire collector or tire <br /> <br />12 processor with more than 500 waste tires shall obtain a permit <br />13 from the agency unless exempted in subdivision 2. The agency <br />14 may by rule reauire tire collectors or tire processors with less <br />15 than 500'waste tires to obtain permits unless exemoted by <br />16 subdivision 2. <br /> <br />. <br /> <br />17 Subd. 2. . [EXEMPTIONS.] A permit is not reauired for: <br /> <br />18 (1) a retail tire seller for the retail selling site if no . <br /> <br /> <br />19 more than 500 waste tires are keot on the business premises1 <br /> <br />20 (2) an'owner or operator of a tire retreading business for <br /> <br />21 the business site if no more than 3,000 waste tires are keot on <br /> <br />22 the business premises; <br /> <br /> <br />23 (3) an owner or ooerator of a business who, in the ordinary <br /> <br /> <br />24 course of business, removes tires from motor vehicles if no more <br /> <br />25 than 500 waste tires are keot on the business oremises; <br /> <br />26 (4) a permitted landfill operator with less than 10,000 <br /> <br /> <br />27 waste tires stored above ground at the permitted site; or <br /> <br />28 (5) a person using waste tires for agricultural purposes if <br /> <br />29 the waste tires are keot on the site of use. <br /> <br />30 Subd. 3. [LOCAL AUTHORITY.] The issuance of an agency <br /> <br />31 permit does not reolace a permit or license reauired under <br /> <br />32 section 400.16 or 473.811. <br /> <br />33 Subd. 4. [PERMIT FEE.] The revenue from permit fees shall <br />34 be credited to the general fund. <br />35 Sec. 95.
