This does not prohibit the storage of unprocessed <br />2 waste tires at a cOllection or. processing facility. <br />3 Sec. 96. [11SA.906] [WASTE TIRE NUISANCE; ABATEMENT.) <br /> <br />4 Subdivision 1. [NUISANCE.) A tire dump unreasonably <br />5 endangers the health, safety, and comfort of individuals and the <br />6 public and is a nuisance. <br />7 Subd. 2. [ABATEMENT.) The agency may abate a nuisance by <br />8 processing and removing the tires. Before taking any action to <br />9 abate a nuisance, the agency shall give notice to the tire <br />10 collector responsible for the nuisance that the tires to be <br />11 processed and removed constitute a nuisance and demand that the <br />12 tires be shredded or chipped or removed within a specified <br />13 period. Failure of the tire collector to take the recruired <br />14 action within the specified Deriod shall result in the issuance <br /> <br />15 of an agency order to abate the nuisance. The abatement order <br /> <br /> <br />16 may include entering the pr~perty where the nuisance is located, <br /> <br /> <br />17 taking tires into public custody, and providing for their <br /> <br /> <br />18 processing and removaL The agency order may be enfo"rced" <br /> <br /> <br />19 pursuartt to the provisions of "section 115.071. <br /> <br /> <br />20 Subd. 3. [RECOVERY OF EXPENSES.) Any reasonable and <br /> <br />21 necessary expenses incurred by the agency for abatement costs, <br />22 and administrative and legal expenses, may be recovered in a <br />23 civil actio~ brought by the attorney general aga[nst any tire <br />24 collector responsible for the nuisance. The agency's <br />25 certification of expenses shall be prima facie evidence that the <br />26 expenses are reasonable and necessary. <br />27 Subd. 4. [OTHER ABATEMENT.) This section does not change <br />28 the existing authority of a person or political subdivision to <br />29 abate a tire dump nuisance. The agency may reimburse a person <br />30 or political subdivision for the costs of abatement. <br />31 Sec. 97. [115A.90B) [MOTOR VEHICLE TRANSFER FEE.) <br />32 Subdivision 1. [FEE CHARGED.) A fee of $4 shall be charoed <br /> <br />33 on the initial registration and each subsequent transfer of <br />34 title within the state, other than transfers for resale <br /> <br />35 purposes, of every motor vehicle weighing more than 1,000 <br /> <br /> <br />36 pounds. The fee shall be collected in an appropriate manner by <br /> <br />72 <br />
