<br />Mediation Services for Anoka County is accepting
<br />volunteers for mediation training. Mediation is an
<br />alternative to the court system for settling disputes.
<br />Volunteers would help people find solutions to
<br />neghborhood problems, landlord/tenant disputes,
<br />employer/employee relations, domestic quarrels and
<br />others.
<br />The 25-hour training program teaches skills that
<br />can be applied to solving everyday conflicts in per-
<br />sonal situations as well as in the mediation setting.
<br />This newly-formed non-porfit organization is head-
<br />ed up by school district #11 board member Karen
<br />Irvin. Her background includes divorce mediation
<br />services and co-directing the Mediation Center
<br />located in St. Paul. Task force members have been
<br />solicited from all parts of the county to ensure
<br />widespread support and familiarity with the program.
<br />People in conflict would use the program's ser-
<br />vices voluntarily and on a no-charge basis. Trained
<br />volunteers help them reach mutual agreements us-
<br />ing win-win techniques. The normal time between
<br />opening a case and concluding with an agreement
<br />is two weeks. A recent survey among Anoka Coun-
<br />ty cities indicated as many as 350 cases per year
<br />could be referred to mediation by city officials alone.

<br />HAZARDOUS WASTE
<br />
<br />If you think that exposure to hazardous waste has
<br />injured your health or damaged your property, you
<br />may be able to get monetary compensation under
<br />a new state program.
<br />Under a law passed last year by the Minnesota
<br />Legislature, you may be eligible to file a claim with
<br />a newly created Hazardous Substance Injury Com-
<br />pensation Board. The five member Board was set
<br />up to deal with claims resulting from exposure to
<br />hazardous substances occurring outside the
<br />workplace. A typical claim might involve a problem
<br />with drinking water, contaminated through the im-
<br />proper disposal of hazardous waste.
<br />The Board has the power to investigate claims,
<br />and award damage payments from a $2,000,000
<br />fund set up by the state. It can compensate injured
<br />persons for medical expenses, lost income, and the
<br />value of lost household labor, as well as providing
<br />death benefits to survivors. It can also pay for clean-
<br />ing up or replacing a contaminated water supply.
<br />In hardship cases, compensation can be provid-
<br />ed to persons who must sell their homes at less than
<br />the appraised value, because of a release of hazar-
<br />dous waste.
<br />The Board gives people a chance to recover
<br />damages for an injury or loss, while avoiding the
<br />costs, delays and uncertainty that can be involved
<br />in filing a lawsuit. It also gives them a way to be com-
<br />pensated even if the persons or organizations
<br />responsible for the problem are unknown, or are
<br />unable to pay any damages.
<br />However, the amount of money the Board can
<br />award is limited. The maximum amount that can be
<br />awarded to one individual, for all types of losses or
<br />injuries, is $250,000.
<br />Reimbursement for lost income is limited to
<br />$24,000 a year, and the limit is the same for
<br />household labor expenses. The limit on reimburse-
<br />ment to homeowners for clean-up or replacement of
<br />a contaminated water supply is $25,000, and reim-
<br />bursement is also limited to $25,000 for losses
<br />associated with the sale of a home.
<br />Persons who file claims with the Board are
<br />restricted from suing for damages at the same time.
<br />Persons who have won a previous lawsuit can only
<br />file a claim if it's impossible to collect whatever
<br />damages were awarded in the suit.
<br />Once the Board reaches a decision, and the per-
<br />son making the claim accepts the compensation of-
<br />fered by the Board, no lawsuit can be filed involving
<br />the same injury or damage problem.
<br />The Board is composed of five members, three
<br />recruited for their professional expertise and two
<br />representing the general public. By law, the profes-
<br />sional members must include an attorney, a physi-
<br />cian familiar with the field of toxicology, and another
<br />health professional familiar with hazardous
<br />substance injuries.
<br />Current members include Byron Starns of Min-
<br />neapolis, attorney member and Board Chair; Dr. C.
<br />John Hodgson, physician member, Rochester; Dr.
<br />Constance Pries, physician/health professional
<br />member, Fridley; and the two members represen-
<br />ting the general public, Richard Mergens of Stillwater
<br />and David Miller of White Bear Lake.

<br />As the winter wind whistles across the ground,
<br />make a landscape map of your yard and consider
<br />where you would want to plant a wind break and
<br />summer shade come next Arbor Day. If fruit trees
<br />are included in your landscape planning, consider
<br />a location with good organic soil BEFORE planting.

<br />Now that the cold season is here, please make an
<br />effort to cut any diseased Oak or Elm trees and
<br />dispose of the brush before the end of March. If you
<br />can meet the distance requirement of 600' to the
<br />nearest neighbor, you are eligible for a 30 day bur-
<br />ning permit. If you cannot meet this distance require-
<br />ment, there is a County disposal site on Hanson
<br />Blvd. between East Main Street and Bunker Hills
<br />Blvd. A minimum charge of $5.00 per pick-up load
<br />is charged for disposal of brush at this site.
<br />Also, this is the best time to do remedial and
<br />decorative pruning of your shade and fruit trees.
