Motion by Commissioner Holm and seconded by Commissioner Shumway to delete Item #13 regarding whether the proposed use is in accordance with the Comprehensive Plan. Further Discussion: Commissioner Howell noted that in the 1970's, Ramsey was advertised as 'horse country'. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Hendriksen, Holm, Shumway and Terry. Voting No: Commissioner Howell. Motion by Commissioner Shumway and seconded by Commissioner LaDue directing that Item #14 of the proposed findings of fact indicate that the proposed use will be appropriate in appearance with the character of the area. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Hendriksen, Holm, Shumway and Terry. Voting No: Commissioner Howell. Motion by Commissioner Hendriksen and seconded by Commissioner LaDue directing that Item #15 of the proposed findings of fact indicate that the proposed use will not be disturbing to existing or future neighboring uses. Further Discussion: Commissioner Hendriksen stated that it is his intention that the conditions of the permit insure that the use will not be disturbing to neighboring properties. Motion carried. Voting Yes: LaDue, Shumway and Terry. Commissioner Howell. Chairman Zimmerman, Commissioners Hendriksen, Voting No: Commissioner Holm. Abstain: Commissioner Hendriksen noted that this case has the characteristics of a neighborhood feud. Motion by Commissoner Hendriksen and seconded by Commissioner Howell to direct City Staff to solicit an independent recommendation relative to the soundness, suitability and safety of Ms. Williams' operation for incorporation into the proposed findings of fact and use as a basis for forming conditions of the conditional use permit. Further Discussion: Commissioner Howell stated that the burden of providing that information should be on the Applicant, not City Staff and taxpayers. Commissioner Hendriksen noted that Ramsey City Code states there is a Horse Council to address matters like this; this implies that in the City's opinion, persons with expertise in the area of horses are most qualified for providing input and recommendations. Commissioner Holm stated that the Commission has sufficient information at this point on which to base a decision. Commissioner Shumway stated that he is on the State Board of Directors of the Minnesota Horse Council and he will request that they compile a report on Ms. Williams' case. Mr. Larry Ferber requested that the City indicate on a map the location of the subject property in relation to the locations of those properties in favor of and those properties opposed to the Williams/Swiggum request. Mr. Swiggum stated that it has come to his attention that there are other horse hobby farms that do not meet acreage/horse requirements but they exist because their neighbors have not complained, the owners do not volunteer information to the City and there is not a sufficient number of City Staff Planning & Zoning/December 6, 1988 Page 6 of 8
