Motion by Commissioner Holm and seconded by Commissioner Shumway to delete <br />Item #13 regarding whether the proposed use is in accordance with the <br />Comprehensive Plan. <br /> <br />Further Discussion: Commissioner Howell noted that in the 1970's, Ramsey <br />was advertised as 'horse country'. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, <br />Hendriksen, Holm, Shumway and Terry. Voting No: Commissioner Howell. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner LaDue directing <br />that Item #14 of the proposed findings of fact indicate that the proposed <br />use will be appropriate in appearance with the character of the area. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, <br />Hendriksen, Holm, Shumway and Terry. Voting No: Commissioner Howell. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner LaDue <br />directing that Item #15 of the proposed findings of fact indicate that the <br />proposed use will not be disturbing to existing or future neighboring uses. <br /> <br />Further Discussion: Commissioner Hendriksen stated that it is his <br />intention that the conditions of the permit insure that the use will not be <br />disturbing to neighboring properties. <br /> <br />Motion carried. Abstain: <br /> <br />Commissioner Hendriksen noted that this case has the characteristics of a <br />neighborhood feud. <br /> <br />Motion by Commissoner Hendriksen and seconded by Commissioner Howell to <br />direct City Staff to solicit an independent recommendation relative to the <br />soundness, suitability and safety of Ms. Williams' operation for <br />incorporation into the proposed findings of fact and use as a basis for <br />forming conditions of the conditional use permit. <br /> <br />Further Discussion: Commissioner Howell stated that the burden of <br />providing that information should be on the Applicant, not City Staff and <br />taxpayers. Commissioner Hendriksen noted that Ramsey City Code states <br />there is a Horse Council to address matters like this; this implies that <br />in the City's opinion, persons with expertise in the area of horses are <br />most qualified for providing input and recommendations. Commissioner Holm <br />stated that the Commission has sufficient information at this point on <br />which to base a decision. Commissioner Shumway stated that he is on the <br />State Board of Directors of the Minnesota Horse Council and he will request <br />that they compile a report on Ms. Williams' case. Mr. Larry Ferber <br />requested that the City indicate on a map the location of the subject <br />property in relation to the locations of those properties in favor of and <br />those properties opposed to the Williams/Swiggum request. Mr. Swiggum <br />stated that it has come to his attention that there are other horse hobby <br />farms that do not meet acreage/horse requirements but they exist because <br />their neighbors have not complained, the owners do not volunteer <br />information to the City and there is not a sufficient number of City Staff <br />Planning & Zoning/December 6, 1988 <br /> <br />Page 6 of 8 <br /> <br /> <br />
