Royal Oaks Realty is trying to develop an 86 acre parcel with 73 single family <br />homes, 152 townhomes, and an 82 -unit senior apartment building. The current zoning of the land is B1 <br />Business and R1 Single Family Residential. The 1995 Comprehensive Plan (the one in effect) calls for <br />the land to be business and residential. <br />In order for the land to be developed, the parcel would need a rezoning (to P.U.D. in this case) and <br />comprehensive plan amendment among other approvals. Our questions are as follows: <br />1) Is a comprehensive plan amendment necessary when we change the zoning that is a different type of <br />land use than shown in the comp plan? <br />2) What happens if we don't amend the comp plan and the City rezones the property anyway? <br />3) Can you describe in writing what the procedure is for minor comprhensive plan amendments (Is a super <br />majority needed for City approval of the amendment ?) <br />Thanks in advance for answering these questions.
