<br />09/05/PO Tlffi 12:05 FAX 651 490 2150 <br /> <br />SEH <br /> <br />I4J 004 <br /> <br />Mr. James Norman <br />September 5, 2000 <br />Page 3 <br /> <br />Scope of Services <br />There are two recommend options for proceeding with the local planning effort: (1) adopt <br />the Lower Rum River Watershed Plan as the City plan, or (2) develop a plan based on the <br />Lower Rum River plan that identifies necessary future planning activities and prioritizes <br />the tasks in a 5 - 10 year implementation program. Both options are designed to develop <br />a plan as quickly as possible and still meet the intent of the regulations: The options are <br />described in more detail below. <br /> <br />Optio'(l ): Adopt the Lower Rum River Watershed Plan. <br /> <br />Minnesota Rules 8410 specifically addresses local planning. In section 8410.0110 - <br />Impaot on Local Government, Subpart 3 states: <br /> <br />"Adoption by reference. All or parts of a watershed management <br />organization plan may be adopted by reference by a local unit of <br />government for all or part of its local plan to the degree specified in the <br />approved organization plan." <br /> <br />Page 118 of the Lower Rum River Plan specifically addresses the issue of adoption by <br />reference: <br /> <br />"Member cities may adopt all or parts of the WMO plan to satisfy the <br />intent of local water management planning. Each member city, if so <br />desired, shall by resolution, adopt portions of or the [WMO plan] <br />document in its entirety for the specified purpose of local water <br />management." <br /> <br />The governing State Statute, Section 103B.235 also addresses local plans, clearly <br />deferring the to the WMO plan. <br /> <br />"Subdivision 2. Contents. (a) Each local plan, in the degree qf detail <br />specified in the watershed plan, shall: (1) describe existing and <br />proposed physical environment and land use; (2) define drainage areas <br />and the volumes, rates and paths of stormwater runoff; (3) identify areas <br />and elevations for stonnwater storage adequate to meet performance <br />standards established in the watershed plan; (4) define water quality and <br />water quality protection measures storage adequate to meet <br />performance standards established in the watershed plan; (5) identify <br />regulated areas; and (6) set forth an implementation program, including <br />a description of official controls and, as appropriate, a capital <br />improvements program." <br />
