<br />. <br /> <br />Community Development Assistant Wald replied yes. <br /> <br />Director of Public Works/Fire Chief Kapler noted that the only issue with private streets is that <br />the City of Ramsey is not geared to take care of the streets and does not intend to ever maintain <br />the private streets. <br />LtQ{P <br />Motion by C)xtlicilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution <br />#01 R12-;A8U adopting Findings of Fact #0589 relating to a request to rezone the subject property <br />from B-1 Business to R-3 Urban Residential adding a finding to state "That the proposed <br />rezoning and development of the property will require a Comprehensive Plan amendment to <br />expand the MUSA boundary to include the subject property." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to introduce an <br />ordinance to rezone the subject property from BRl Business to RR3 Urban Residential based on <br />the Findings of Facts. <br /> <br />. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Zimmerman, Anderson, <br />and Hendriksen. Voting No: None. <br /> <br />Councilmember Hendriksen noted that the City has changed more property from business to <br />residential and they need to remember that in other areas ofthe City. <br /> <br />Case #7: <br /> <br />Request to Rezone Property from BRl Business to RR3 Urban Residential; <br />Case of Eighty Seven LLC <br /> <br />Principal Planner Trudgeon stated that Eighty Seven LLC has submitted an application to rezone <br />the property located in the southwest quadrant of T.R. #47 and 153rd Avenue NW from B.l <br />Business to R-3 Urban Residential. The rezoning would allow the applicant to develop <br />townhomes on the property. The property is approximately 8.75 acres in size and is within the <br />Metropolitan Urban Service Area (MUSA). The general development plan that accompanied the <br />application proposes to develop the property with townhomes at a density not to exceed seven <br />units per acre. The current Comprehensive Plan (1995) identifies this area for development with <br />commercial uses. The March 2001 Draft Comprehensive Plan proposes to change the land use of <br />the subject property from commercial to medium density residential. The new Comprehensive <br />Plan has not been finalized and adopted; therefore, if the rezoning is approved, an amendment to <br />the current Comprehensive Plan (1995) will be required. Properties to the south and west of the <br />subject property are zoned R-1 Residential; properties on the north side of 153Td Avenue and the <br />east side of T.H. #47 are zoned B-1 Business. The Planning Commission conducted the public <br />hearing, reviewed the request, and recommended City Council approval of the proposed <br />. rezoning. <br /> <br />City Council/December 11, 2001 <br />Page 22 of 25 <br />
