Staff is recommending that the City <br />proceed with the installation of the recommended signage changes to the intersections of Alpine <br />Boulevard and CSAH 83 and Alpine Boulevard and CSAH 56 at an estimated cost of $1200. <br />Motion to recommend that staff be directed to proceed with the installation of the recommended <br />signage changes to the intersections of Alpine Boulevard and CSAH 83 and Alpine Boulevard <br />and CSAH 56 at an estimated cost of $1200 with the cost of the signage to be from the Public <br />Works sign account. <br />Action: <br />This recommendation was acted upon at November 28, 006 meeting. No further action is <br />required. <br />Case #2 Consider Penalties for Violations of the Sign Ordinance <br />Background: <br />The general provisions section of Chapter 9.12 of the City Code prohibits all signs except those <br />placed by governmental units within the public rights of way. The Public Works Department has <br />been diligent in enforcing this provision of the ordinance and has been removing violating signs <br />whenever such signs are discovered or reported. Removed signs are discarded; however the low <br />cost of many of these signs causes the same type of violation to occur repeatedly. This effort • <br />causes an expenditure of Public Works staff time and resources and defeats the desired goal of <br />maintaining the rights-of-way free of advertising signage. Staff feels that a progressive policy <br />for dealing with repeated violations would have a positive effect on achieving the goal of <br />maintaining the rights-of-way free of unauthorized signage. Input was requested from the <br />Committee on the following progressive system included in the draft ordinance: <br />1" violation a written notice shall be given by registered mail <br />2nd violation within a twelve month period a fine of $50 shall be imposed <br />3rd and subsequent violations within a twelve month period a fine of $100 shall be <br />imposed <br />The Committee discussed the proposed fees included in the draft ordinance and enforcement of <br />the fees. The following suggestions were made: <br />■ Likely need for an internal appeal process for' people that state they did not violate the <br />ordinance because the sign was moved. <br />■ Need for consistency in enforcement. <br />■ Copy of the ordinance or information on where to obtain information about the ordinance <br />included with written notice of a violation. <br />The Committee discussed the following penalty structure: <br />■ 1St violation a phone call <br />■ 2nd violation written notice shall be given by registered mail with the warning of a <br />penalty. It was noted if the violation results in a misdemeanor it would carry its own <br />penalty. <br />—164— <br />
