Associate Planner Dalnes indicated this has been changed from commercial car washes being
allowed as a conditional use to accessory car washes being allowed as a permitted use. This
would permit car washes associated with another use, which would be required to go through a
site plan process.
Commissioner Van Scoy noted a permitted use states that the use is allowed, while a conditional
use gives the City a choice in approving the use.
Chairperson Nixt pointed out the City was able to work to properly locate the car wash in the
Coborn's site plan due to the conditional use as a qualifier. With a permitted use, if the
applicable setbacks are met, the City does not have the ability to force the conditional nature of
that use.
Associate Planner Dalnes indicated this will be changed to accessory car washes as a conditional
use.
Commissioner Van Scoy requested information regarding the change in the front yard setbacks.
Associate Planner Dalnes explained this came up with the build -to lines. With the stoops on the
houses and businesses they need to allow for doors to open without being in the right -of -way. To
avoid this occurrence, a couple of feet has been allowed so that when a business door opens it is
not being opened into the right -of -way.
• The Commission discussed requiring doors to be recessed, rather than changing the front yard
setbacks. Commissioner Van Scoy noted the build -to concept was a major component of Town
Center.
Associate Planner Dalnes indicated the change in the front yard setback versus the requirement
for a recessed door will be revisited.
Commissioner. Van Scoy requested. information regarding the proposed change to allow S* stories
in the TC -2 and TC -3 district, as he thought a transition from the core area was planned.
Associate Planner Dalnes explained the change would not disallow buildings of this size, but the
thought was not necessarily that there would be buildings of this height. The decrease in density
from the core area may not have been considered with this proposed change; she can understand
the reasoning for leaving this as 3 stories.
Commissioner Van Scoy indicated he would be more comfortable allowing 4 stories, rather than
5.
Chairperson Nixt indicated he would prefer to deal with a 5 -story building in these areas as a
variance if a request were to come forward.
•
Planning Commission /January 4, 2007
—33—
