financing l'br the extension of City sanitary sewer and water. This feasibility study was presented <br />to tile Council on March 25, 2003. The proposed improvements are feasible within the financing <br />scenario presented in the report. It was noted that the report recommends that drainage <br />improvements should be undertaken along with the sewer and water to eliminate an existing <br />problem .just south ol~ the railroad tracks. The financing for this project would come through <br />special assessment to Oak Terrace Estates under Minnesota Statute 429 and City Code 4.60. A <br />public hearing needs to be held on this project as a requirenLent of these statutes. Following the <br />public hearing, the Council may direct modifications to the feasibility study, which shall then <br />become basis l"or the improvement project. According to City Code 4.60, no further action may <br />be tal<en on this project for a 60-day period. There is some question as to. whether Sunfish <br />Properties, wlnich is located east of the mobile home park, is a benefited property. Although the <br />sanitary sewer must be extended westward through their property to reaclL Oak Terrace Estates, <br />their property is presently serviced with both sewer and water. Sunfish Properties has agreed to <br />extend th.is sanitary sewer at their expense at such time as an anticipated frontage road is <br />constructed. Sunfisln Properties was notified o1: this meeting and was provided with a copy of the <br />feasibility study. Further action on tile project will require some cooperation between Oak <br />Terrace Estates and Sunfish Lal<e Properties concerning the issues of drainage. The cost of <br />ext'ending thc sanitary sewer through Sunfish Properties is somewhat anLbiguous; therefore, staff <br />recommendccl that tile Council direct the two parities to negotiate tlnese two issues. Further <br />action can be considered by the Council at such time that an agreement is reached by these two <br />parties, or tile 60-day period has passed. <br /> <br />Citizen Input <br /> <br />Rob Griffin, Manager o[~ Still'fish Conllxlons, stated that the language in their Development <br />Agreement states that they will pay for the extension of sewer and water at the time a fi'ontage <br />road is clcvclopccl. Now, because the neighboring property has petitioned :l~or the extension of <br />sewer and water, they may be forced to extend the services earlier than anticipated and because <br />o[" that tine5, cio not feel tlney slnould Imve to pay for it. He realizes that the City could force the <br />fl'ontage road to be constructed as well; therefore, forcing them into the project, in addition, they <br />lmve a retaining pond on the northwest corner of their property to serve their site and there was <br />an assunnption made in the feasibility study that the mobile home park could drain their water <br />into tine pond. It also showed possible expansion of the pond, which would have to be done on <br />their land. Pal'king is an issue at Sunfish Commons and expanding the pond would impact any <br />~5uture possibilities of expanding parking. If tile mobile home park is allowed to drain water in <br />their pond hc would want to be relinquished tile responsibility of caring for the pond. They <br />already have a problenn witln children fi'om the trailer park putting garbage into their retention <br />pond, which they have discussed with the property owner of the trailer park. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Elvig, to close the public <br />hearing. <br /> <br />Motion carried.
