Absent: None. <br />6.02: Public Hearing: Consider Ordinance #26-11 Amending Chapters 30 (Nuisances) and <br />106 (Zoning Code) of the City Code Related to Managed Natural Landscapes <br />Public Hearing <br />Chairperson Gengler called the public hearing to order at 6:40 p.m. <br />Presentation <br />Senior Planner Anderson presented the staff report stating that the Environmental Policy Board <br />(EPB) recommends adoption of Ordinance #26-11. <br />Commissioner Bauer noted that some HOAs have rules that would prohibit this and asked which <br />regulation would supersede the other. <br />Senior Planner Anderson commented that the intention of the State Statute is that this type of <br />landscaping cannot be prohibited, but stated that he would follow up with the City Attorney prior <br />to the review of the City Council. <br />Commissioner Musgrove noted the language within the draft ordinance and asked if this applies <br />to areas of certain sizes. <br />Senior Planner Anderson stated that language is related to pocket pollinator areas, which would <br />not require a management plan. <br />Commissioner Musgrove acknowledged that size was most likely related to the average lot size <br />within the MUSA and provides a homeowner the opportunity to have a small pollinator garden. <br />She stated that there are some lots in the MUSA that are larger and asked if someone planning a <br />pollinator garden larger than that would need to follow this process. <br />Senior Planner Anderson explained that if vegetation would exceed eight inches in height, in an <br />area greater than the identified square footage, it would be subject to a management plan. <br />Commissioner Musgrove commented that there are some lots that are five acres in size with large <br />ornamental grass landscaping and felt that the language might be restrictive to that type of <br />situation. <br />Senior Planner Anderson stated that the Planning Commission could suggest additional language, <br />such as ten percent of the lot size, which could provide more flexibility. <br />Planning Commission/ July 23, 2026 <br />Page 3 of 10 <br />
