<br />City be allowed to make payment in three equal portions, with the third payment upon <br />completion of the project. Ms. Reed Kone stated she discussed this request with Stacy Waters, <br />Vice President of Waters Consulting Group. Ms. Waters informed her that Waters Consulting <br />Qroup is not comfortable with that request. In their mind they would have completed all the <br />work and would not receive payment until completion of what the City considers the final step. <br />Ms. Waters noted that they provide a triple guarantee which states if the selected person resigns <br />within two years of appqintment or the City terminates the individual for cause within the two <br />years, Waters Consulting Group would come back and perform the search again for expenses <br />only. <br /> <br />Councilmember Jeffrey asked if the contract has been reviewed by the City Attorney. <br /> <br />Human Resources Manager Reed Kone replied it has not. <br /> <br />Councilmember Jeffrey indicated approval of the contract will need to be contingent on City <br />Attorney approval. <br /> <br />Councilmember Elvig asked about the terms included in the proposal from Waters Consulting <br />Group. <br /> <br />Human Resources Manager Reed Kone replied the terms include payment of 30% at the <br />beginning of phases one, two and three, with 10% upon completion ofthe project. <br /> <br />Councilmember Elvig stated he is comfortable with the terms. They are close to his request, and <br />include 40% of the payment with the last 1/3 ofthe project. <br /> <br />Councilmember Jeffrey stated he is pleased with the triple guarantee included with the proposal. <br /> <br />Human Resources Manager Reed Kone indicated the contract is actually the proposal; the City <br />would sign off that they agree with the terms listed in the proposal. This will be included with <br />the Consent Agenda of tonight's City Council meeting for approval contingent upon City <br />Attorney review. <br /> <br />City Attorney Goodrich advised with the approval of the Consent Agenda it should be stated that <br />the approval of this item will be cOI!tingent on City Attorney review. <br /> <br />Human Resources Manager Reed Kone stated once this document is approved, the first step <br />would be a meeting between Andrea Sims and Councilmembers, and whoever else Council <br />would like to meet with her. Ms. Sims is available any day except February 28th. Ms. Reed <br />Kone requested input from Council on a meeting date and who should be included in the <br />meetings. The purpose of the meetings will be to develop the position profile and will include <br />quite a bit of discussion in what Council would like to see in a city administrator, priorities of the <br />City over the next few years, the skill set that is being looked for, and the challenges/issues the <br />city administrator would face in the job. Ms. Sims will be coming from Cleveland for the <br />meetings. Sometimes there are opportunities for members of commissions to participate; one <br />option would be for this to be done in writing, with Ms. Sims meeting with department heads and <br /> <br />City Council Work Session / February 13,2007 <br />Page 3 of 6 <br />
