<br />Fire Chief Kapler indicated there is a statement included in the special events permit application <br />about additional fire permits. It should be clear they are not asking for additional fees, but the <br />permits need to be in place because of specific requirements in relation to fire inspections. <br /> <br />Councilmember Dehen inquired about current time restrictions in relation to music. <br /> <br />Police Chief Way explained there is nothing currently included under City Code. The time <br />included in the public nuisance ordinance is 10:00 p.m. With the Happy Days festival there have <br />been complaints from Andover and further north than 179th Avenue about music going until <br />10:30 p.m. <br /> <br />Mayor Gamec commented the first year of the Happy Days festival he received several <br />complaints. Since the music has ended prior to II :00 he has not had any problems. <br /> <br />Police Chief Way indicated music for the Happy Days festival now ends at 10:30 instead of <br />11 :00 because of the complaints. This is not covered in City Code; it is addressed under the <br />public nuisance ordinance. If there are neighborhood complaints about music they are usually <br />allowed to continue until 10:00 p.m. <br /> <br />Councilmember Elvig noted Mr. Gruber of Diamonds is not present to address this topic; it had <br />been scheduled for the worksession prior to this meeting. He noted the proceeds from the event <br />will go to support the troops and things of that nature. <br /> <br />Police Chief Way stated Mr. Gruber indicated a preference for a 12:00 a.m. or 12:30 a.m. cut off <br />time for the music when he submitted the application. <br /> <br />There was considerable discussion of the appropriate timeframe to allow music for special <br />events. Councilmember Dehen expressed his support in allowing a midnight cut off time for this <br />event at Diamonds. The event is only held once per year and 10% of the proceeds will go to <br />support the troops. Councilmember Strommen indicated she would not be in support of allowing <br />music until midnight. Council further discussed the appropriate timeframe to allow music for <br />special events. <br /> <br />Councilmember Look asked if the request from Diamonds is to allow the music until midnight <br />for both days of the event. <br /> <br />A representative of Diamonds stated this is a two-day event with a lot of sponsorship, including <br />KQRS and Channel 4. Diamonds is hoping the City will permit them to hold this special event. <br />She believes the request is for music to go until midnight both nights. She stated most people do <br />not come out to see a band until 10:00 at night. This is a chance for people to see how great this <br />City is and what they have done with it.
