If anyone doing the speed limit, or exceeding the <br />limit, was approaching this street, the potential for an accident is extreme, not to mention <br />school bnses stopped to pick np children. <br /> <br />In discussion with the Anoka County Highway Dept, they ask that as property on the <br />south side of the road comes up for sale, they are demanding a 60' easement from the <br />center of the highway south. The property on the north side of the highway has already <br />been plotted for the 60' easement with future road improvements in mind. Anaka County <br />should be contacted to see if this is a legal and safe access and what would be needed to <br />assure that this happens. <br /> <br />The applicants, George and Denise Swanson, request for this variance permit submitted <br />the wrong legal description to the property. (See A attached) On December 12, 1983, <br />this property was purchased by James Hennnm a realtor from Tony and Shirley Rice. On <br />October 7, 1985, the parcel was sold to Carl McCollum. A title search was never done on <br />the parcel upop. purchase and the legal description was changed from the original writing <br />by Jim HennuDl. This lot is part of the NE quarter of section 6 Anoka County. This <br />section is 1,331' long and normal is 1,320'. The legal description that has been submitted <br />by the applicant has omitted that eleven foot discrepancy. (See B) No permits should be <br />granted until the eleven foot discrepancy has been cleared and clear title has been found. <br />Building "set backs" and easement "right of way" cannot be determined until such <br />information has been corrected. <br /> <br />"Attachment C" is a copy of the legal description from February 20, 2007 which still <br />shows Carl McCollum as the owner, with no correction to the legal description. <br /> <br />As growth and development are inevitable. a little fore thought and wise decision <br />planning on these issues now could avoid many late nights and problems for future <br />developments down the road for the City of Ramsey. <br /> <br />John Enstrom <br />8702-181" Avenue NW <br />Ramsey, MN 55303 <br /> <br />2. <br /> <br />11 <br />
