Case ~/2: Recommendation of Park Dedication for Gobernatz 2"d Addition

Mr. Boos reviewed the background describing the City Council's approval of Mr. Gobernatz's
request for final plat approval for a minor subdivision. This issue concerns a 35-acre parcel of
land along Trott Brook Corridor. He added that a cash contribution in the amount of $1,500 total
(which includes a trail fee per lot) is satisfactory with Mr. Gobematz.

Vice Chairperson Johns stated a contribution of land rather than cash would be a better
alternative.

Mr. Boos replied that the City Council has only deviated from a request like Mr. Gobernatz's
once before, contributing cash rather than land. Land dedication in the form of an easement
provides the owner with control over the property. Mr. Boos is recommending that the
Commission work with the developer to explore all options.

Commissioner Rolfe stated that Staff is equipped to negotiate with the developer, and to make
recommendations regarding the interests of Trott Brook Corridor.

Vice Chairperson Johns said a strong emphasis should be placed on a land contribution rather than
cash.

Mr. Boos agreed, adding that the community's long term needs are at stake, and that this issue
will be looked into further.

Case #3: Award Bids for Used Playground Equipment

Mr. Boos reviewed the background of this agenda item, stating that only two bids were received
from the public towards purchase of the used playground equipment. He said that after the
purchases were completed, the City would be available to assist with loading the equipment for
the buyer, and possibly with the delivery of it as well. Construction of the playground site is
scheduled for July 10. Landscaping will also be looked at during the late summer/fall.

Commissioner LaMere asked if selling the used equipment poses any liability on the City's part.

Mr. Boos replied that there is a waiver citing no liability for the City is incorporated in the bid
form.

Acting Chairperson Johns read the bids. The swing was bid on by one group at $25. The
overhead ladder was bid on by one group at $25. The arched climber was bid on by both groups
- the higher bid was $65. The metal slide was bid on by both groups - the higher bid was $65.
The wood structure was bid on by both groups - the higher bid was $25.

Mr. Boos stated that the City Council has approved the sale of the equipment with the proceeds
being added back into the park. All pieces were bid on, and he will notify the buyers.

Park and Recreation Commission/June 11, 1998
Page 6 of 11
