Councilmember Haas Steffen stated she would be reluctant to do that. She felt the past
practice is what we would have to go by now. We would open the door for a number of
issues if we didn't continue in the same way. She felt we need to talk to an attorney
about the situation. She reiterated she would be reluctant to do anything different until all
the City is paved.

Mr. Lamprecht stated that the north half of the road is off so many feet. He stated that he
has several pines planted on the side of his driveway and the City may not know how far
the road will shift. He wondered what may happen to his trees.

Mr. Jankowski responded that as soon as the report is done, the City will have the
surveying done so we will know how far the road will shift before the project starts. It
will be staked so Mr. Lamprecht would be aware of where it will go.

Motion by Councilmember Haas Steffen and seconded by Councilmember Zimmerman
that Mr. Lamprecht will be notified immediately if his pine plantings are in danger due to
a shift in the road.

Motion carried. Voting Yes: Councilmembers Haas Steffen and Zimmerman. Voting
No: None. Absent: None.

CONSENT AGENDA

None

COMMITTEE BUSINESS

Case #1: Drainage Easement Filling

City Engineer Jankowski stated he thought Todd and Jennifer Asmussen may be coming
for this case and since they were not yet present, he asked to go on to Case #2, coming
back to Case #1 when the Asmussen's arrive.

Case #2: Access to Foster Cemetery

City Engineer Jankowski stated that the access to Foster Cemetery was placed on the
agenda at the request of Councilmember Haas Steffen. He presented a sketch of the
cemetery property which is surrounded by Lot 1 of Block 1 of the Bury & Carlson
Addition on three sides and by the Royal Concrete property on its east boundary. He
explained that, historically, whenever access to the cemetery was required, City crews
enter over the old airport property without objections from the property owners. When
the property was platted by Bury and Carlson in 1998, access to the cemetery was
negotiated in the development agreement along a 33-foot strip along the northern and
eastern border of Lot 1.

Road and Bridge Committee - September 16, 1998
Page 2 of 8
