Case gl: Drainage Easement Filling <br /> <br />City Engineer Jankowski stated he received a telephone call from a neighborhood <br />resident indicating that a ponding area located at the northeast terminus of Helium Street <br />in Pondvale Second Addition was being filled. This easement over Lots 1 and 2 of Block <br />2 was dedicated on the plat of the Pondvale Second Addition which was recorded in <br />1984. Todd and Jennifer Asmussen are the fee owners of these two lots, along with Lot <br />3, which is the site of their residence. After verifying the filling by a site visit, Mr. <br />Jankowski phoned Mrs. Asmussen to advise her that the filling was inconsistent with the <br />City's easement rights and requested that further filling cease and that the fill placed be <br />removed. He also sent a letter to that effect. He noted that the fill placed appears to be <br />mostly sand, but some dark seams observed on the edge of the fill suggest that some <br />topsoil may be included. Some of the material filled may have been excavated from the <br />pond bottom. The fill placed has been leveled nearly flat and the fill edge has a nearly <br />vertical face with ranges between four to seven feet in height. He stated that he hoped to <br />have a discussion with Todd and Jennifer Asmussens as to what they are trying to <br />accomplish. They have erosion concerns and the only place he has noticed erosion is on <br />the spillway where the street comes in. The Asmussens say the hole gets bigger every <br />year. The Public Works Department has gone in and pushed soil up the sides. It is <br />washing out in sheets. About three years ago, Mr. Jankowski suggested they could bring <br />in better topsoil. <br /> <br />Councilmember Haas Steffen stated she wants to know if the City has an easement to <br />deposit water on someone's property. She felt we ought not to create an eyesore and this <br />is an eyesore. We should develop a policy where we have to put in some sort of rock. It <br />is a mess out there. <br /> <br />Mr. Jankowski stated that if you could put fabric down and put rip rap over it, but the <br />weeds will eventually grow though it. He mentioned maintaining it. <br /> <br />Councilmember Haas Steffen stated that there would not be much to maintaining that. <br />She asked why The City Engineer was not in favor of doing that. <br /> <br />Mr. Jankowski responded because it is expensive, it is not in the budget, it is not <br />necessary for erosion purposes, and it was a gentle depression with sparse turf. <br /> <br />Councilmember Zimmerman stated that may we want to identify more of these around <br />the City and decide what we want to do. <br /> <br />Councilmember Haas Steffen felt that the Asmussen's were doing what they thought they <br />could do. <br /> <br />Mr. Jankowski reiterated that he has a problem with it. <br /> <br />Road and Bridge Committee - September 16, 1998 <br /> Page 6 of 8 <br /> <br /> <br />
