Ms. Frolik replied that the 15 feet was not subtracted from the plat - it was taken from two lots <br />and added onto another lot. <br /> <br />Mike Purvis, 6025 - 157th Lane NW, Ramsey, inquired if there would be bicycle trails running <br />in front of his house. <br /> <br />Mayor Gamec responded that there's one on T.H. #47 but he is not sure where else or if there <br />will be another. <br /> <br />Mr. Purvis expressed a concern about the increased amount of traffic with regard to the children <br />in the area. <br /> <br />Councilmember Haas Steffen stated she wanted to be certain that the restricted covenant is not <br />lost and that the park request is honored. <br /> <br />Mr. Goodrich assured her that when phase five is approved, we need to have in place the <br />restricted covenants on those lots. <br /> <br />Motion by Couneilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #98-02-035 granting final plat approval to Apple Ridge. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen and Beyer. Voting <br />No: CouncilmemberZimmerman. Absent: CouncilmemberBeahen. <br /> <br />Case #4: <br /> <br />Authorize Additional Planning Services Regarding Charter Chapter 14 and <br />Legal Research Regarding Charter Amendment Issues <br /> <br />City Attorney Goodrich stated there are concerns regarding the legality of Chapter 14 of the City <br />Charter and we need to have additional planning services to address that issue. There are serious <br />issues concerning this and we have now been sued. He asked that Council amend the contract <br />with the Hoisington Koegler Group, Inc. for additional services as outlined in a letter, dated <br />February 18, 1998, from Fred Hoisington. (The letter states that Hoisington's role will be to <br />make an objective interpretation of the 1997 Charter Amendment and evaluate its impact on <br />affected vacant parcels within Ramsey's MUSA. It will be their intent to document the results of <br />the study in a written and graphic report that will serve as the basis for future decisions by the <br />City Council.) Mr. Goodrich also requested that Council authorize the City Attorney and the law <br />firm of Kennedy & Graven to research the legal issues and give their legal opinion on those <br />subjects within the next 60 days at a cost not to exceed $4,000. <br /> <br />Mayor Gamec pointed out that the Finance Committee had discussed fimding for additional <br />planning and recommended Council authorize a budget amendment allocating $30,000 from the <br />1997 excess revenues in the General Fund to take care of the additional planning that is <br />anticipated. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to amend the <br />Hoisington Koegler Group, Inc.'s current comprehensive plan services contract by adding <br /> <br />City Council/February 24, 1998 <br /> Page 10 of 18 <br /> <br /> <br />
