Mayor Gamec recessed the Council meeting at 9:08 p.m. Mayor Gamec reconvened the Council meeting at 9:18 p.m. Case #4: Request for a Conditional Use Permit to Operate a Two-Family Rental Unit in the Single Family District; Case of Scott and Gwyn Simpson Zoning Administrator Frolik stated that on February 24, 1998, the City Council was presented with Scott and Gwyn Simpson's request for a conditional use permit to operate a two-family rental unit in the single family district at 16001 Nowthen Boulevard NW. At that time, City Council directed staff to refine the proposed findings of fact and conditional use permit terms based on the discussion that evening. Mayor Gamec inquired of Ms. Simpson if she has read and understands the findings and permit to which Ms. Simpson stated she has and does. Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt Resolution #98-03-040 adopting (in the positive) Findings of Fact #0450 regarding the Simpson's request for a conditional use permit for a two-family rental unit at 16001 Nowthen Boulevard NW. Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen and Haas Steffen. Voting No: Councilmember Zimmerman. (Councilmember Zimmerman voted no because the owners do not live on the premises.) Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt Resolution #98-03-041 approving the request for a conditional use permit to establish a two- family rental unit at 16001 Nowthen Boulevard NW, and declaring terms of same. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen and Beyer. Voting No: Councilmember Zimmerman (same reason). Case #5: Request for Revised Site Plan Approval; Case of Vision-Ease Lens Zoning Administrator Frolik explained that, in 1997, the City Council approved the site plan for Vision-Ease Lens for an accessory structure in which to store organic peroxides used in their manufacture of polycarbonate based products. The materials are considered hazardous and should be stored in accordance with the guidelines of the National Fire Protection Association, Factory Mutual Engineering Corporation, and PPG Industries, the peroxide manufacturer. The approved site plan consisted of a 250 square foot, one-room, metal building on a concrete slab on grade. It was centered in a 46' by 46' area of crushed gravel, surrounded by a 6' chain link fence. The metal building was to be encompassed by a landscaped earth berm approximately nine feet high around the west, south and east sides of the building. Ms. Frolik continued that Vision-Ease has since found the costs for the bermed structure to be outside their budget. The excessive costs were due to the earth berming. Therefore, a decision was made to go with a structure consisting of reinforced masonry walls. This construction will resist the pressure City Council/March 10, 1998 Page 13 of 24
