will create a minor amount of additional water runoff but with lots of this size the water should <br />not get into the roadway ditch due to the existing berm. He explained that Mr. Lonfield is <br />concerned if the resident decides to remove the berm. Mr. Jankowski stated taking the berms <br />down could be deemed to significantly change the drainage patterns and require a drainage <br />permit. However, sometimes people do not apply for those permits prior to the start of grading. <br /> <br />Councilmember Haas Steffen stated it appears this issue was not addressed by the Planning <br />Commission and asked if approval can be granted contingent upon the berms not being removed. <br /> <br />Mr. Jankowski stated he spoke with Mr. Lonfield and determined if a problem occurs they could <br />bulkhead the water so it remains on the other side. Also, it may not be a problem unless Mr. <br />Lonfield's property is developed. <br /> <br />Councilmember Beyer asked if this could be a potential problem with a drainfield or a failed <br />septic system. <br /> <br />City Attorney Goodrich asked if an easement should be granted to the City so maintaining the <br />berm is an option. <br /> <br />John Gobematz, 17515 St. Francis Boulevard NW, stated if he removed the berm the water <br />would run into his field which would be a disadvantage to him. <br /> <br />City Attorney Goodrich asked if he would object to providing an easement to the City for the <br />area of the berm. <br /> <br />Mr. Gobernatz stated it depends on how wide it is. <br /> <br />Ms. Frolik stated the City already has a ten foot easement. <br /> <br />Councilmember Haas Steffen stated the applicant wants to pull a building permit in a timely way <br />and asked if consideration could be contingent upon the City Engineer and Mr. Gobematz <br />identifying an easement that would protect Mr. Lonfield. <br /> <br />City Attorney Goodrich stated this could be done and suggested it be included into the motion. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #98-06-126 granting final plat approval to Gobernatz 2nd Addition subject to <br />compliance with the City Staff review letter dated June 3 1998, and the recommendations of the <br />Park Commission and contingent upon the City Engineer and applicant agreeing on a proper <br />easement for the berm just discussed. <br /> <br />Motion Carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen, and <br />Zimmerman.
