Councilmember Zimmerman. Voting No: None. <br /> <br />City Attomey Goodrich advised the Council will need to adopt an ordinance to place a <br />moratorium on certain sensitive parcels and that will be presented for introduction at the next <br />meeting. <br /> <br />Zoning Administrator Frolik stated it will add parcels west of the MUSA to the golf course and <br />some selected commercial and industrial properties within the MUSA. <br /> <br />Wayne Johnson, Realtor, stated he owns a parcel on Ramsey Boulevard that is within the MUSA <br />line and zoned industrial but they have had difficulty in trying to sell it as industrial. He advised <br />they do have a proposal to rezone the property for townhomes but then it would become subject <br />to the moratorium. Mr. Johnson stated he is simultaneously requesting it be exempted because of <br />its small size and the fact that this proposal would be in accordance with the proposed <br />Comprehensive Plan. However, if the developer fails to gain the rezoning or financing and fails <br />to close, he would want the property to remain industrial. He would then request it not be in the <br />moratorium since it is zoned industrial and within the MUSA. <br /> <br />City Attorney Goodrich stated there is a procedure to exempt property from the moratorium <br />when and if it is included in the moratorium. He agreed that the proposed ordinance for next <br />week would include Mr. Johnson's property in a moratorium. City Attorney Goodrich stated <br />those exclusions are considered on a case-by-case basis and Mr. Johnson's case can be argued at <br />the next meeting when the ordinance is considered for introduction. <br /> <br />Mr. Johnson asked if his proposal can move forward even if it's in the process. <br /> <br />Ms. Frolik explained that Mr. Johnson's property is zoned industrial, is in the MUSA and not in <br />the current moratorium. However, if Mr. Johnson is requesting a residential use then it would be <br />automatically included in the moratorium. <br /> <br />Mayor Gamec requested that Mr. Johnson work with staff on this issue. <br /> <br />Councilmember Haas Steffen stated even if this property is not within the moratorium, once Mr. <br />Johnson or the buyer comes in to request a subdivision and rezoning to residential, that move <br />alone would sweep the property into the moratorium, regardless of the action taken by the <br />Council tonight or at the next meeting. She stated if Mr. Johnson goes ahead there is a procedure <br />to address his request for exemption but that may or may not be approved. <br /> <br />Motion by Councilmember Haas Steffen and Councilmember Beahen to direct staff to prepare a <br />moratorium ordinance to include sensitive properties which were not previously included in the <br />moratorium with the recommendation from Hoisington Koegler. <br /> <br />Motion Carried.
