before the Council for a formal consideration. <br /> <br />Councilmember Haas Steffen stated if the consultant provides a dear statement that the parcel <br />should remain in the moratorium it would not even appear before the Council. She read their <br />recommendation which indicates "Our opinion is that Outlot A, Regency Pond, remain in the <br />development moratorium to allow time for the Comprehensive Plan to be completed. However, <br />the Council may choose to accept the request to remove this parcel from the moratorium. If the <br />Council so chooses, careful consideration should be given (during site plan review) to the density <br />issue relative to current comprehensive planning discussions as they progress during the months <br />of June and July. Further consideration should also be given to the status of the two parcels <br />between the subject parcel and Ramsey Boulevard to enable future development and or <br />redevelopment." Councilmember Haas Steffen stated this is not a very clear statement of what <br />they recommend and she is inclined to say "no" but is also inclined to say the City will probably <br />not get commercial or industrial development on this parcel. She noted the townhouse plan as <br />distributed by Mr. Schmidt and stated the only way it should have been forwarded to the Council <br />is if the Hoisington Koegler Group reviews the plan and indicates it is consistent. Councilmember <br />Haas Steffen suggested they be asked for a more clear, less fuzzy, answer. <br /> <br />Councilmember Beyer stated if the moratorium is lifted on this parcel it will open a "can of <br />worms." She stated the Comprehensive Plan process is so close to the end, she believes the <br />Council should let it take its course. <br /> <br />Mr. Schmidt stated they would like to request a rezoning and suggested they be allowed to bring <br />in the proposal under a rezoning request with this plan so the City's consultant can review it and <br />provide a recommendation. Then they can move forward with development this year. He advised <br />that a similar drawing was reviewed by the consultant and they indicated it is consistent with the <br />Comprehensive Plan. He requested that the moratorium be waived so rezoning can be applied <br />for. <br /> <br />Ms. Frolik clarified that Mr. Schmidt had applied for a rezoning and he had been advised that the <br />City has 60 days to provide an answer but the "clock" would not begin until Mr. Schmidt had <br />received an exemption from the moratorium. <br /> <br />Mayor Gamec asked if a rezoning request can be made if the property remains within the <br />moratorium. City Attorney Goodrich stated he can request it but it would not be considered. <br /> <br />Mr. Schmidt suggested this is making the property unusable and the Council is arbitrarily and <br />selectively indicating development for certain parcels. <br /> <br />Mayor Gamec stated the consultant could rezone this property as part of the Comprehensive Plan <br />so a rezoning application is not needed.
