City Attorney Goodrich recommended that the Council declare findings for denial. <br /> <br />Ms. Frolik presented the following findings: <br /> <br />Finding # 1: <br /> <br />The current version of the draft land use map for the comprehensive plan update <br />identifies a change in the land use of the subject property from industrial to <br />transitional but an acceptable density for transitional residential is unknown at this <br />time. <br /> <br />Finding #2: The property rights will be returned at the conclusion of the moratorium. <br /> <br />Finding #3: <br /> <br />The requested exception to the moratorium may be detrimental to the public <br />welfare and other properties in the area. <br /> <br />Finding #4: <br /> <br />The exception could set a precedent for release of other properties from the <br />moratorium, which will adversely affect the planning process for amendments to <br />the comprehensive plan <br /> <br />Finding #5: <br /> <br />At the present time, we can only determine that the proposed use may be <br />consistent with the intent of the moratorium ordinance and the comprehensive plan <br />amendment. <br /> <br />Councilmember Beyer and Councilmember Zimmerman withdrew the motion on the floor and the <br />second so the Council could address the findings of fact for denial. <br /> <br />Councilmember Haas Steffen asked if the findings of fact for denial were reviewed with the <br />consultant. <br /> <br />Ms. Frolik stated they were not. <br /> <br />Mr. Johnson stated this property is zoned industrial but Councilmembers have indicated support <br />for commercial uses. He advised that this location will never support a commercial use. He <br />explained he has other commercial properties in a far superior location that are not selling. Mr. <br />Johnson explained that even if there was a demand for commercial, this property is zoned <br />industrial and, as Mr. Schmidt indicated, the adjoining residents would not support industrial <br />development adjacent to their houses. He asked how these findings of fact to support a <br />recommendation for approval of exemption can be changed at the "drop of a hat" to support <br />denial. <br /> <br />Mayor Gamec explained that the findings are a staff recommendation but the Council can make <br />changes to those findings. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to accept the <br />findings of fact for denial as amended and indicated above. <br /> <br />City Council/July 14, 1998 <br />Page 11 of 18 <br /> <br /> <br />
