Voting Yes: Mayor Gamec, Councilmembers Beyer, Zimmerman, and Beahen. <br />Voting No: Councilmember Haas Steffen. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to deny the <br />request of Wayne Johnson and TSM Development, Inc. for exemption to the moratorium <br />ordinance for Outlot A of Regency Pond. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Zimmerman, Beahen, and <br />Haas Steff.en. Voting No: None. <br /> <br />Councilmember Haas Steffen stated she does not consider this to be very good work. She <br />clarified that the motion she made previously said if the consultant objected then it should not <br />come before the Council. If the issue is before the Council, the findings of fact should be <br />reviewed by the consultant. Councilmember Haas Steffen stated she agrees with the comment <br />made by Mr. Schmidt that the Council arbitrarily finds negative findings of fact. She stated that at <br />the very least, the findings should have been provided to the consultant for their recommendation. <br />Councilmember Haas Steff.en stated she expected a "yes" or "no" recommendation but, instead, <br />got a recommendation that they prefer it remains in the moratorium but. She stated that she does <br />not want to see another "but." Councilmember Haas Steff.en stated she wants a clear "yes" or <br />"no" recommendation. <br /> <br />Mayor Gamec concurred and stated the Hoisington Koegler Group is doing the planning and <br />should be expected to provide a clear recommendation. He stated he cannot see industrial on this <br />parcel either and would appreciate better information from the consultant. <br /> <br />Councilmember Zimmerman stated this area was placed into the moratorium and the Council <br />cannot, as the next issue, take it out. He encouraged showing respect for the planning process <br />and stated if you bear with the process it does provide input from the public. Councilmember <br />Zimmerman stated that following the process will result in a stronger city. <br /> <br />Case #4: <br /> <br />Request for Authorization for Execution of a Development Agreement with <br />Northern Airgas <br /> <br />City Attorney Goodrich explained that Northern Airgas, which will be located in Development <br />District No. 1 and Tax Increment Financing District No. 2, is a distributor of industrial, medical, <br />and specialty gasses and related equipment and services. Staff.has been negotiating with Northern <br />Airgas for approximately a year and the project has been reduced in size from the original <br />proposed project. <br /> <br />City Attorney Goodrich advised that the proposed Northern Airgas project will include a 29,336 <br />square foot warehouse facility and a proposed 11,440 square foot assembly building to be built <br />sometime in the future. The Assessor's estimated market value on the facility has been placed at <br />$1,450,000, however, Northern Airgas has agreed to the original market value amount of <br />$1,550,000 for the developers agreement. Northern Airgas has reduced the size of the lot <br />because of the reduction in the original project size.
