Staff recommends the Council <br />authorize the execution of the development agreement with Northern Airgas, contingent upon <br />review by the City Attorney. <br /> <br />Councilmember Zimmerman asked if this proposal incorporates enough room for expansion in the <br />future. <br /> <br />Mr. Ted Erkenbrack, Northern Airgas, replied there is. <br /> <br />Councilmember Haas Steffen stated the Council approved a project for a pond on this property <br />and asked if this firm will pay for part of that project. <br /> <br />Mr. Jankowski advised that the grading was to be done by Northern Airgas. <br /> <br />Councilmember Haas Steffen stated it was discussed that a funding source would have to be <br />determined and asked if the previous motion will have to be reconsidered or if this development <br />agreement will indicate that Northern Airgas will pay for the pond grading work. <br /> <br />City Attorney Goodrich suggested the development agreement include the indication that <br />Northern Airgas will pay for that portion of the pond work. <br /> <br />Mr. Erkenbrack stated it was part of the original agreement that they would pay for the ponding. <br /> <br />Mr. Jankowski explained the project came to the point where the grading needed to be completed. <br /> <br />Mr. Erkenbrack stated that they would have no problem with including that provision in the <br />development agreement. <br /> <br />Councilmember Haas Steffen stated she understands this was addressed in the original <br />development agreement. <br /> <br />Mr. Jankowski advised it was part of the original site plan and they, as the developer, agreed to <br />do the site grading of the pond. <br /> <br />Mr. Erkenbrack noted that additional grading is needed on the north end of the pond. Mr. <br />Jankowski stated this is correct. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to authorize the <br />execution of the development agreement with Northern Airgas, relating to Lot 1, Block 1, <br />Ramsey Business Park 7th Addition, which was executed previously, dated June 1, 1998, with the <br />amendment of Exhibit C entitled Site Plan Development Permit to provide the developer will <br />reimburse the City of Ramsey in the amount as determined by the City Engineer and City <br />Attorney for pond grading and contingent upon review by the City Attorney. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen, and <br />Zimmerman. Voting No: None. <br /> <br />City Council/July 14, 1998 <br />Page 13 of 18 <br /> <br /> <br />
