NEW BUSINESS <br /> <br />Case #2: <br /> <br />Adopt Ordinance to Establish Development Moratorium on Certain Parcels <br />within the Metropolitan Urban Service Area <br /> <br />Zoning Administrator Frolik explained that on June 23, 1998, the Council introduced an <br />ordinance to impose a development moratorium on certain parcels within the Metropolitan Urban <br />Service Area (MUSA) that have been identified by City staff as land use sensitive with respect to <br />the Comprehensive Plan update which is in progress. Ms. Frolik advised that in accordance with <br />the City Charter, the ordinance is now eligible for adoption. Staff recommends adoption of the <br />proposed ordinance to establish a moratorium on the development of certain parcels of land <br />located in the City of Ramsey. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to adopt <br />Ordinance//98-08 Establishing a Moratorium on Development of Certain Parcels of Land Within <br />the City of Ramsey, Anoka County, Minnesota. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, Beyer, and <br />Zimmerman. Voting No: None. <br /> <br />Case #3: <br /> <br />Request for Exception from Development Moratorium; Case of Wayne <br />Johnson and TSM Development, Inc. <br /> <br />Zoning Administrator Frolik explained that the Council just adopted an ordinance to establish a <br />development moratorium on certain land use sensitive parcels (with respect to the Comprehensive <br />Plan update) which are within the MUSA. The moratorium includes a parcel located in the <br />northeast quadrant of the intersection of County Roads #56 and #116, just west of Regency Pond. <br />This parcel is owned by Wayne Johnson and he has entered into a purchase agreement with TSM <br />Development. They have requested an exception to the moratorium to proceed with a plan to <br />rezone the property from Industrial to R-3 Urban Residential and develop it with townhomes. <br />Ms. Frolik advised that the moratorium ordinance provides for exception when compliance may <br />result in undue hardship and the Council has the authority to grant an exception to the <br />moratorium with conditions desirable for the protection of the public interest. <br /> <br />Ms. Frolik advised that the request for this exception was forwarded to the Hoisington Koegler <br />Group for review and recommendation. The Hoisington Koegler Group prefers that the parcel <br />remain in the moratorium, but if the Council chooses to grant the exception, they urge careful <br />consideration be given to the density issue during site plan review relative to the land use and <br />density discussions currently in progress. Ms. Frolik presented the criteria and findings as <br />contained in her staff report and advised that staff recommends the Council grant an exception to <br />the Moratorium Ordinance to Wayne Johnson for Outlot A, Regency Pond. <br /> <br />Wayne Johnson, 710 Dodge Avenue, Elk River, reiterated what was stated in his correspondence <br />to the City that they have not been able to rezone this property to residential, which appears to be <br />the market for this parcel since it is adjacent to single family homes, because of the moratorium. <br />He noted that this is a small piece of property which has been off the market for about one year <br /> <br />City Council/July 14, 1998 <br /> Page 8 of 18 <br /> <br /> <br />
