Councilmember Haas Steffen stated that she believes that this property owner has <br />indicated that if we are going to buy this property that we consider rezoning and one of <br />the stipulations made was that staff check with the City's Comprehensive Planner <br />Hoisington. <br /> <br />Mr. Norman referred to the acquisition map and noted the area between Parcel 4 and the <br />"shed". He stated that we need to ask the Department of Natural Resources how close we <br />can put the road to the wetland. Brad Scheib of Hoisington feels that maybe the City <br />would have to purchase parcels 5 and 6 in their entirety as it appears that the remaining <br />150' width of those parcels is too small to do any type of development. <br /> <br />Councilmember Haas Steffen pointed out this is a project that's been planned prior to the <br />current Council. This gentleman has been wanting to sell his property to the City for a <br />number of years and there is a definite need for an east/west road in this City. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />amend the 1998 Capital Improvement Program to include the 153/155 Avenue Extension <br />from the 1999 scheduled year, and to direct staff to begin negotiations with all the <br />property owners involved. The funding would come out of the MSA funds. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen and <br />Beyer. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Case #5: <br /> <br />Request for a Conditional Use Permit to Grade Soils; Case of Ronald <br />Kabat <br /> <br />City Engineer Jankowski stated that the City received a request for a conditional use <br />permit from Ronald Kabat to grade soils on Lot 4, Block 5, Fox Ridge Estates. He <br />explained that the applicant is proposing to mine soils from the pond and dirt mound on <br />the site to raise the elevation of the property between the house and the pond to make the <br />backyard more useable. The project will enlarge the southeast comer of the pond by <br />about 40 feet and increase the depth of the pond from approximately six inches to three <br />feet. The project does not include any importing or exporting of soils from the site. The <br />site has been reviewed and the wetland has been delineated. No filling is proposed for <br />any wetland areas. There was one neighbor present at the public hearing conducted by <br />the Planning Commission who was in support of Mr. Kabat's request. Mr. Kabat has <br />been in contact with the Anoka Conservation Services. Staff is recommending approval <br />of the request with the provision that Mr. Kabat observes the wetland delineation. This <br />easement was on the property to protect the wetland. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #98-08-206 adopting Findings of Fact #0468 relating to a request from <br />Ronald J.
