Absent: CouncilmemberZimmerman. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to add <br />Term #4: (as suggested by the City Attorney) The Permittee shall comply with the <br />staking elevations as currently placed on the site by the Soil and Water Conservation. <br /> <br />Motion carried. Absent: CouncilmemberZimmerman. <br /> <br />Case #9: <br /> <br />Adopt Ordinance to Rezone Property from B-1 Business to R-3 Urban <br />Residential; Case of Rademacher Companies, Inc. <br /> <br />Zoning Administrator Frolik stated that on October 28, 1997, Council adopted a findings <br />of fact and introduced ordinances to rezone Lot 1 and a part of Outlot A in Rademacher <br />Addition from B-1 Business to B-2 Business and R-3 Urban Residential, respectively. <br />The purpose for rezoning Lot 1 to B-2 Business was to facilitate development of the <br />parcel with a convenience store that included gas sales. The purpose for rezoning a <br />portion of Outlot A to R-3 Urban Residential was to match the zoning already existing on <br />the remainder of Outlot A. Council went on to adopt the ordinance for the rezoning to B- <br />2 Business but could not go beyond introducing the R-3 Urban Residential ordinance at <br />that time because of the moratorium on rezoning residential property. Staff recommends <br />final adoption of the R-3 rezoning ordinance. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Ordinance #98-12 rezoning part of Outlot A, Rademacher Addition, to R-3 Urban <br />Residential, contingent upon positive review by the Comprehensive Planner - Hoisington. <br /> <br />A roll call vote was called by the Deputy City Clerk. <br /> <br />Councilmember Beahen aye <br />Councilmember Haas Steffen aye <br />Councilmember Beyer aye <br />Mayor Gamec aye <br />Councilmember Zimmerman absent <br /> <br />Motion carded. <br /> <br />Case #10: <br /> <br />Adopt Ordinance to Establish Development Moratorium on Certain <br />Parcels Outside the Metropolitan Urban Service Area <br /> <br />Zoning Administrator Frolik stated that the City Council introduced an ordinance, on <br />August 11, 1998, to establish a development moratorium on land use sensitive parcels, <br />relative to the new comprehensive plan, generally located outside the Metropolitan Urban <br />Service Area.
