Ms. Frolik noted that the City has approved overages in single accessory <br />structure size limits in the past. As required by City Code, the Planning Commission <br />conducted a public hearing. One letter was received from an adjacent neighbor who was <br />not opposed to the proposed size of the Dvorak accessory building as long as it was built <br />in accordance with City Code and Building Code. The Planning Commission and staff <br />recommend approval of the Dvorak's request. <br /> <br />Councilmember Haas Steffen inquired if the Dvorak's are planning to use this for a <br />business to which Mr. Dvorak replied no, it's strictly for storage. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt <br />Resolution #98-10-256 adopting Findings of Fact #0475 relating to a request from <br />Stephen and Barbara Dvorak for a conditional use permit to exceed the maximum single <br />accessory structure size allowed on parcels one acre or less in size. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen, Haas <br />Steffen and Zimmerman. Voting No: None. <br /> <br />Case #3: <br /> <br />Request for a Home Occupation Permit to Establish a Dog Grooming <br />Business in the R-1 Residential District; Case of Julie Kucia <br /> <br />Zoning Administrator Frolik reported that on September 15, 1998, the City received an <br />application from Julie Kucia for a home occupation permit to establish and operate a dog <br />grooming business in her home at 16511 Yttrium Street NW. The subject property is <br />approximately one acre in size and is zoned R-1 Rural Residential. The surrounding <br />parcels are zoned R-1 Rural Residential. Ms. Frolik pointed out that Ms. Kucia is <br />proposing to operate her business from 9:00 a.m. to 6:00 p.m., Monday through Friday. <br />She anticipates 20 clients per week and the business use will not exceed 20% of the gross <br />floor area of the home. Ms. Kucia will be the sole employee. No exterior storage of <br />equipment or materials is necessary. The dogs will be indoors at all times and the <br />driveway is sufficient in length to provide off-street parking to customers. Similar <br />requests for in-home pet grooming businesses have been granted in the past. A public <br />hearing was conducted by the Planning Commission. One comment was in support of the <br />request, one in support of the request provided there is no business sign displayed and <br />two were in opposition to the request.
