Motion by Commissioner Deemer, seconded by Commigdoner Wivoda, to amend Findingg of <br />Fact/t16 to reflect that the use will not create excessive additional requirements at public cost for <br />public facilities and services, and it will not be detrimental to the economic welfare of the <br />community. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Wivoda, Anderson, <br />and Jensen. Voting No: None. Absent: Commissioner LaDue and Terry. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Jensen, to amend Findings of Fact <br />/117 to reflect that the use will not involve activities and uses that will be detrimental to any <br />persons, property, or the general welfare by reason of excessive production of traffic, noise, <br />smoke, fumes, glare, or odors. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Jensen, Anderson, <br />and Wivoda. Voting No: None. Absent: Commissioner LaDue and Terry. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Wivoda, to recommend that City <br />Council adopt the amended Findings of Fact relating to Philip and Frances Teetzel's request for a <br />conditional use permit for a private dog kennel of more than two adult dogs. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Wivoda, Anderson, <br />and Jensen. Voting No: None. Absent: Commissioner LaDue and Terry. <br /> <br />Chairperson Bawden asked if Mr. Teetzel received a copy of the proposed conditional use permit <br />and agreed with the conditions. Mr. Teetzel indicated he had not received a copy. Community <br />Development Assistant Walther supplied Mr. Teetzel with a copy for his review. <br /> <br />Commissioner Anderson inquired if the City provides additional services to applicants having <br />more than two dogs when they request a kennel license. Zoning Administrator Frolik stated the <br />terms in the kennel license are not anything more than would be expected of a resident having <br />only two dogs. However, the kennel permit will allow the City to monitor nuisance reports and <br />rescind the privilege of more than two dogs if necessary. <br /> <br />Mr. Teetzel questioned condition #6 stating no dog would be allowed to run at large on the <br />property, except under owner supervision. He asked if the condition correlated with the fence. <br />Commissioner Deemer stated there was no correlation with the fence. <br /> <br />Chairperson Bawden stated he was uncertain why the dogs could not run at large within the <br />fenced area of the property. Commissioner Jensen suggested the dogs be permitted to run at <br />large only in a confined area. <br /> <br />Mr. Teetzel stated people pass his property, kick his fence and disturb the dogs.
