<br />Commissioner Trites Rolle explained the Commission needs to look at the Statute in the books at <br />the particular time and how the land is zoned. She requested input from the applicant regarding <br />tlle loading dock located at Jaspar Street and 138th Avenue, which appears to be a tight fit. <br /> <br />Mr. Klain replied there will be more than enough of a tunnng radius. All rubbish, etc. will be <br />inside the double bays; the only exterior trash disposal areas will be up towards the bank. They <br />are trying to minimize as much of the impact as they can by not having the back of tIns building <br />with a road that has trash enclosures and doors, and bringing as much of that inside the <br />development as they can. There may be some revisions to the loading docks. If there is an <br />anchor tenant that wants the top corner location they may be able to move the loading dock at <br />Jasper Street and 138th Avenue inside the front of the building. The only problem would be the <br />lost commercial space that would result from a double or triple bay loading dock at the bottom <br />left hand corner of the site, and the project would not be able to sustain itself. <br /> <br />Chairperson Nixt inquired about access to the' enclosed loading dock in the soutl1east comer. <br /> <br />Mr. Klain replied the access would be in the early hours into the main entrance. The trucks will <br />pull in and back out. This has been worked out with Pioneer Engineering and will be shown to <br />engineering staff. <br /> <br />Commissioner Cleveland inquired about the possibility of flipping the developnient so the back <br />side is not against the residents. <br /> <br />Mr. Klain replied if the development is flipped to the other side the residents would be affected <br />, by the quantity of cars, noise, signage, etc. all the time. The way the plan has been presented <br />there is a wall with sloping roofs as a buffer and there will be vegetation put in around it; this <br />cannot be done if everything is flipped. There would be a line of 100 cars up against the edge to <br />meet the same square footage requirements if it were to be flipped. He believes it would be <br />better to have the building buffering everythi1lg. It has been zoned for this pmiicular use since <br />they were building the Ryland homes. This is a commercial development that takes deliveries <br />and has people accessing it; it needs to be accessible or there will be a lot of non-leasable spaces. <br /> <br />Commissioner Brauer stated the 600 pound gorilla in the room is whoever sold these folks their <br />places and made promises about what would not be on this site, because tIns has always been <br />zoned commercial from the day this was platted out. There is nothing the Commission can do <br />about that. Anything commercial is legal right now for the site; the only way tlley will not have <br />commercial is to change the zoning. He would urge the residents to try to work with the <br />developer and figure out something; he sounds like he is willing to work with the residents to get <br />something in there that might at least work out for them. <br /> <br />Chairperson Nixt indicated the objection of the residents to what is proposed for this site is <br />noted. The suggestion to the residents is to contact their City Council representatives mld to <br />work with the developer. <br /> <br />Commissioner Brauer commented the larger thing is tl1at this is a classic example of where <br />zoning does not really all fit together. <br /> <br />Planning Commission!
