<br />Chairperson Nixt stated he does not agree with that statement. This was intended to be an <br />urbanized area; other urbanized areas have retail, commercial and residential working in tandem <br />effectively. He has a different opinion regarding the use, in that if he lived across the street he <br />would rather look at a well manicured area adjacent to a building providing a separation from a <br />parking facility than to look at cars pulling up and shil1ing their headlights 12 hours per day <br />during the winter months. <br /> <br />Chairperson Nixt requested input from the Commission regarding any concerns about the site <br />plan. <br /> <br />Mr. Lindberg expressed concel11 regarding the loading dock located at Jaspar Street and 138th <br />Avenue. He stated there are kids running around there all the time unsupervised, and there will <br />be an incident where a kid will be hit because a truck does not see them. <br /> <br />Chairperson Nixt indicated he has an objection with the layout of the loading dock located on <br />Jaspar Street and 138th Avenue as it is included in the site plan. <br /> <br />There was discussion regarding the loading dock located on Jaspar Street and 138th Avenue. <br /> <br />Chairperson Nixt stated the developer has done a masterful job to provide use of the building <br />structure as a theoretical buffer. The areas where the concept falls short .are the location of this <br />loading dock on Jaspar Street and 138th Avenue with the dock being external from the <br />development resultillg in impacts from sound issues during deliveries in the moming and <br />evening, as well as a safety issue of using a public street and stopping traffic. <br /> <br />Mr. Klain indicated this will be addressed. <br /> <br />Chairperson Nixt suggested that less glass should be included on the eastern elevation as this <br />moves forward to address the residents' concel11s. <br /> <br />Mr. Lindberg suggested the elevation be changed so that the residents do not have a view of the <br />inside of the restaurant. <br /> <br />Civil Engineer II Linton indicated staff has expressed concem regardillg the loadillg docks. The <br />Staff Review Letter indicates that the location of the westernnlost access is a large safety <br />concern. Staff is very adamant that the developer work with Village Bank to obtain a common <br />access easement. <br /> <br />Mr. Klain questioned how discussion would be opened to take out the bank's existillg access at <br />this time. <br /> <br />Chairperson Nixt replied this type of agreement is not uncommon. This is a logical concern of <br />staff that he shares. While he suppOlis the layout that has been presented subject to addressing <br />the stated issues, dual access on roads this close together is a problem. He indicated the <br />applicant should work with the bank to work out a reciprocal access agreement and work with <br />staff regarding the loading dock on Jaspar Street and 138th Avenue.
