financing for the extension of City sanitary sewer and water. This feasibility study was presented <br />to the Council on March 25, 2003. The proposed improvements are feasible within the financing <br />scenario presented in the report. It was noted that the report recommends that drainage <br />improvements should be undertaken along with the sewer and water to eliminate an existing <br />problem just south of the railroad tracks. The financing for this project would come through <br />special assessment to Oak Terrace Estates under Minnesota Statute 429 and City Code 4.60. A <br />public hearing needs to be held on this project as a requirement of these statutes. Following the <br />public hearing, the Council may direct modifications to the feasibility study, which shall then <br />become basis for the improvement project. According to City Code 4.60, no further action may <br />be taken on this project for a 60-day period. There is some question as to whether Sunfish <br />Properties, which is located east of the mobile home park, is a benefited property. Although the <br />sanitary sewer must be extended westward through their property to reach Oak Terrace Estates, <br />their property is presently serviced with both sewer and water. Sunfish Properties has agreed to <br />extend this sanitary sewer at their expense at such time as an anticipated frontage road is <br />constructed. Sunfish Properties was notified of this meeting and was provided with a copy of the <br />feasibility study. Further action on the project will require some cooperation between Oak <br />Terrace Estates and Sunfish Lake Properties concerning the issues of drainage. The cost of <br />extending the sanitary sewer through Sunfish Properties is somewhat ambiguous; therefore, staff <br />recommended that the Council direct the two parities to negotiate these two issues. Further <br />action can be considered by the Council at such time that an agreement is reached by these two <br />parties, or the 60-day period has passed. <br /> <br />Citizen Input <br /> <br />Rob Griffin, Manager of Sunfish Commons, stated that the language in their Development <br />Agreement states that they will pay for the extension of sewer and water at the time a frontage <br />road is developed. Now, because the neighboring property has petitioned for the extension of <br />sewer and water, they may be forced to extend the services earlier than anticipated and because <br />of that they do not feel they should have to pay for it. He realizes that the City could force the <br />frontage road to be constructed as well; therefore, forcing them into the project. In addition, they <br />have a retaining pond on the northwest comer of their property to serve their site and there was <br />an assumption made in the feasibility study that the mobile home park could drain their water <br />into the pond. It also showed possible expansion of the pond, which would have to be done on <br />their land. Parking is an issue at Sunfish Commons and expanding the pond would impact any <br />future possibilities of expanding parking. If the mobile home park is allowed to drain water in <br />their pond he would want to be relinquished the responsibility of caring for the pond. They <br />already have a problem with children from the trailer park putting garbage into their retention <br />pond, which they have discussed with the property owner of the trailer park. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Elvig, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, <br />Strommen, and Zimmerman.
