-206- <br /> <br />Subdivision 5.d shall be added and shall read as follows: A variance will be required to exceed <br />the established height restrictions for accessory buildings. The variance shall be processed in <br />accordance with the procedures established in Section 9.03.05 of the City Code. Criteria <br />governing consideration ora variance request to exceed height restrictions on accessory <br />buildings shall include, but not be limited to the following: 1. Whether the variance will impair <br />an adequate supply, of light and air to adjacent property~ 2. Whether the variance will have the <br />effect of allowing a use that is prohibited in the applicable zoning district. 3. Whether :the <br />variance will impair established property values within the neighborhood. 4. Whether the <br />increased height will be compatible with the principal building on the same parcel. 5. Whether <br />the increased height will be compatible with existing development in the immediate <br />neighborhood. 6. Whether the variance requested is the minimum variance necessary to <br />accomplish the intended purpose of the applicant. <br /> <br />Subdivision 8 shall be renumbered as Subdivision 7 and amended to read as follows: Any <br />accessory building proposed to be within five (5) feet, overhang tO overhang, of the principal <br />building shall either be made structurally a part of the principal building or the wail and soffit <br />area of the accessory building that is within five (5) feet of the principal building shall be <br />constructed to a 1-hour fire rating.. <br /> <br />Subdivision I 0 shall be renumbered as Subdivision 9 and amended to read as follows: For lots <br />two (2) acres (8%120 square feet) or greater in-size, the detached accessory building may be <br />located nearer the front property line than the principal building provided the following criteria <br />are met: <br /> <br /> a. The placement of the detached accessory building maintains compliance with the <br /> standard front yard structure setback requirement for the respective zoning <br /> district; and <br /> <br /> b. The Exterior materials used on the detached accessory building match those of the <br /> pdncipat building on'the subject property; and <br /> <br /> c. The accessory building is designed with soffit, fascia and cave overhang. <br /> <br />On lots less than two (2) acres (87,120 square feet) in size, the accessory structure shall be <br />located in the side or rear yard and shall not be located nearer the front property line than the <br />principal building on that lot, unless a variance is obtained. This provision shall not apply to <br />attached garages that maintain compliance with the applicable front yard setback requirement. <br /> <br />Subdivision 12 shall be amended t° note that the exterior design and materials must be the same <br />as the home on parcels 2 acres and larger in size if the accessory building is located nearer the <br />front property line than the home; and that the design must include a soffit, fascia and eave <br />overhang on all lots in excess of 5.6 acres if the building is located closer to the front property <br />line than the principal building. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following official summary of OrdinanCe #03-__ has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br /> <br />
