-120- <br /> <br />City Engineer Jm~<owski replied that City Code requires that there be a bituminous access for <br />any unit that receives a certificate 'of occupancy. <br /> <br />Councilmember Kurak inquired if the City could be dragged into the issue where a property <br />owner's fence encroaches onto the berm located on the developer's property. <br /> <br />City Attorney Goodrich replied that he did not think the City' would be involved because the <br />issue has been resolved between the developer and property owner. <br /> <br />Councilmember Zimmen2an inquired if the. location of the frontage, road would line up with a <br />future frontage road through the County Park and in front of Diamonds. <br /> <br />City Engineer Jankowski replied that that location has never been .identified, but there is a <br />commitment on the part of the County for the frontage road to continue. <br /> <br />Motion by Councilmember Kurak, seconded by C0uncilmember Cook, to. adopt Resolution <br />#03-01~010 to. approve the preliminary plat of Rivenwick 3rd Addition contingent upon <br />compliance with City staff review letter dated September 27, 2002, revised November 8, 2002, <br />revised January 10, 2003 and the developer 'receiving a rezoning of that portion of the subject <br />property which is zoned B-I Business, the fence issue with the' neighbor being resolved, <br />occupancy permit not being issued for any units until the road is completely constructed with <br />lights at the intersection Ramsey Boulevard and Highway #10 to approval of the City and <br />I'vhlDOT. <br /> <br />Further discussion: Councilmember Pearson inquired if the City would have to pay the cost of <br />redoing the intersection of C.R. #56 and Highway #10 in the future if the frontage road is <br />extended. Mayor Gamec replied that they would probably use MSA funds since it is a MSA <br />road. Councilmember Pearson stated that if they allow a temporary intersection and then it. has to <br />be redone he would like to. know who would have to pay the bill. Councilmember Kurak replied <br />tl~at she did not believe that it would be a temporary intersection. City Engineer Jankowski <br />explained that the intersection of. Ramsey Boulevard and Riverdale Drive would need to move <br />200 feet to the south at an estimated cost of $180,000. The estimated cost of signalizing the <br />intersection is $150,000 to $200,000. One of those costs will definitely be incurred if the project <br />occurs. Staff recommended that the developer be responsible for the construction of the <br />intersection and hold him harmless if the intersection needs to be relocated. Staff feels that there <br />is some benefit of the intersection other than to the developer, which is why they made their <br />recommendation. <br /> <br />Motion camed. Voting-Yes: Mayor Gamec, Councilmembers Kurak, Cook, Elvig, Pearson, <br />Strommen, and Zimmerman.
