Actually, with the reduction of 190 units to 186 units, park dedication fees will need to be <br />refunded to the developer. This will be commented on in the final plat review letter and the final <br />development agreement. Ms. Geisler stated the engineering plans have been reviewed and some <br />minor modifications have been noted. The master developer has defaulted on the construction of <br />turn lanes from Town Center Drive to Bunker Lake Boulevard. K. Hovnanian will complete <br />several other public improvements that were supposed to be constructed by the master developer; <br />the construction of those improvements is a higher priority than those turn lanes, and because of <br />the priority and the fact that Bunker Lake Boulevard will be reconstructed in two years, which <br />will remove those turn lanes, it is not being required that those turn lanes be constructed. Ms. <br />Geisler advised staff recommends preliminary plat and preliminary site plan approval to <br />Symphony at Town Center, contingent upon compliance with the City Staff Review Letter dated <br />April 26, 2007, revised May 17, 2007, with the exception of the park dedication requirement and <br />the requirement for the construction of turn lanes which is being addressed in the final plat <br />documents. <br /> <br />Mr. Sean Ciders, K. Hovnanian, thanked the Council for the opportunity to discuss the <br />Symphony at Town Center neighborhood. He indicated this proposal will address the demand in <br />the housing styles. It will increase the number of chateau homes and decrease the number of row <br />house townhomes. K. Hovnanian has taken great care in designing this community. The park <br />dedication fees will not be due with this plan. As K. Hovnanian will not be constructing the turn <br />lanes, they understand it is possible that intersection may be closed by the County. K. <br />Hovnanian has a number of final engineering plans and understands they generally comply with <br />the City's requirements. Mr. Ciders thanked staff for their hard work. <br /> <br />Councilmember Jeffrey asked if the fees that are due back to the developer include sewer and <br />water trunk fees. <br /> <br />Associate Planner Geisler explained those fees were calculated based on 190 units, which was <br />collected under the RTC 7ili Addition. With the replat to 186 units the City owes K. Hovnanian <br />four unit rebates on each of those park dedication and sewer and water trunk fees. <br /> <br />Councilmember Jeffrey asked if the cost of staff time to recalculate the changes will be <br />recovered by the City. <br /> <br />Associate Planner Geisler replied yes, a new escrow has been submitted and the developer is <br />being charged for staff time. <br /> <br />Councilmember Elvig expressed concern in giving up the required turn lanes. <br /> <br />Associate Planner Geisler indicated as she understands, the turn lanes were to be constructed by <br />RTC, LLC. After drawing on the securities for the work done to date there are not sufficient <br />funds to cover the turn lane construction or the balance of the remaining public site <br />improvements that need to be done around 7ili Addition or Symphony. K. Hovnanian is picking <br />up the construction of things like streetscaping and trails, which staff feels is important to the site <br />development.
